Four civil cases involving Daniel F. Froman and/or Pauline Froman were transferred to Judge Roger M. Prokes on Sept. 22. Judge Prokes is from the Fourth Judicial Circuit (Atchison, Gentry, Holt, Nodaway and Worth Counties). The cases against Daniel and Pauline Froman for grain stealing, grain dealer fraud and filing false financial statements were transferred to Judge Prokes earlier.

Arraignment for the grain cases is scheduled for 1:30 p.m. on Sept. 25.

The four additional cases were transferred to Judge Prokes upon the court’s own motion, due to the fact that local court personnel have an interest in the case. The cases are as follows: State of Missouri Ex Rel vs. Daniel Fallis Froman and Pauline K. Froman, petition for ex parte order appointing trustee pursuant to grain dealer and grain warehouse law; State of Missouri, Missouri Clean Water Commission and Missouri Department of Natural Resources vs. Danny Froman and Gallatin Livestock Auction; Grinnell Mutual vs. Daniel Froman et al; and Berten etal vs. Daniel Froman. No court dates have been set on these civil cases.

The most recent charges against Daniel F. Froman, filed Aug. 21, remain in the Daviess County Associate Circuit Court. The charges are sexual assault and two counts of tampering with a witness. The preliminary hearing in this case is Sept. 28 before Judge Daren Adkins.

The following cases were heard by Judge Brent Elliott on Sept. 16:

William C. Worley failed to appear for a motion hearing. A warrant was issued for his arrest, with bond set at $250,000 cash. The charges are possession of controlled substance with intent to distribute and five counts of possession of chemicals with intent to manufacture controlled substance.

Following a probation violation hearing, the suspended execution of sentence was revoked for Brigette L. Callaway, on a charge of possession of controlled substance. The previously imposed sentence of five years in the Department of Corrections was ordered executed.

A warrant was issued for the arrest Nancy M. Poff, for a probation violation on a forgery charge. She is to be held without bond pending a revocation hearing.

Shawn P. Trude was ordered to serve 42 days shock time in the regional jail for a probation violation for possession of controlled substance. Upon completion and payment of costs, he was ordered discharged and released.

A dissolution of marriage was granted to Shanna Gilreath from Cody Gilreath.

A judgment was entered for Carissa Manning by next friend Amy Manning, in a petition for approval of a minor settlement, and against Dale Schupert and Steel Warehouse Company LLC.

The following cases were heard Sept. 17 by Judge Jason Kanoy:

The jury trial for Kevin W. Caldwell, charged with distribution of controlled substance near schools and involuntary manslaughter, was reset to April 29-30, 2010.

Following a probation violation hearing, the suspended execution of sentence for William Bruce Hetrick Jr. was revoked. The previously imposed sentence of four years in the Department of Corrections for DWI, aggravated offender, class C felony, was ordered executed.

State vs. Brooke Nicole Marriott was assigned to Judge Jason Kanoy. She is charged with two counts of theft/stealing of any livestock animal, class C felony; two felony counts of theft/stealing; and two misdemeanor counts of theft/stealing.

The following case was heard by Judge James Valbracht on Sept. 21:

Delbert M. Crossley plead guilty to DWI, persistent offender, class D felony, and operated motor vehicle without valid license, class A misdemeanor. He waived the sentence assessment report, and was sentenced to four years in the Department of Corrections, execution of sentence suspended, and received five years probation on the first count. He was fined $150 on the second count.

Criminals cases filed: State vs. Donald Dee Corbin, Bethany, deviate sexual assault, class C felony; two counts of sexual misconduct first degree, class A misdemeanor; two counts of sexual misconduct second degree, class B misdemeanor.

Civil cases filed: State ex rel vs. Charles D. Brandom, Branson, certificate of lien, DOR, taxes; State ex rel vs. Jane A. McKinsey, Gallatin, certificate of lien, DOR, taxes; Kraig Justin Mort vs. Freida Christine Mort, both of Gallatin, dissolution of marriage.

County Commission

James Lewis, bridge supervisor, reported that they will install culverts this week.

Matt Clark, Lincoln Township, met with the Commission reporting that they have five culverts that need repairs after the recent six-inch rain. Some have eroded so badly that equipment cannot cross. The commission will inspect.

Keith Sutton, Farm Bureau, met with the commission regarding the possible BRO funding.

Tom Kober, Landmark Manufacturing, met with the commission regarding the stimulus package involving recovery bonds. He will contact a bonding attorney to start the process.

Mike Waterbury met with the commission reporting that brush has been cleared in Marion Township, section 21, as requested.

Ben Becerra, sheriff, met with the commission regarding security during the re-wiring project. Also, they discussed parking for his department during Chautauqua.

The commission inspected roads in Benton and Jefferson Townships.

Sheriff’s Office

Ronald Turrell of Liberty reported that an ATV and trailer were stolen from the back of his truck in the parking lot at I-35 Speedway on Sept. 19, between 7 and 11 p.m.

Justin Thomas, 22, Trenton, was arrested Sept. 21 for probation violations on a misdemeanor count of resisting arrest. He is being held on $1,000 bond.

Buford Brooks, 30, Lee’s Summit, was charged Sept. 20 with failure to appear on a misdemeanor charge of possession of marijuana. He is being held on $1,000 bond.

Charles Pettipeace, 39, Holt, was arrested Sept. 18 for misdemeanor DWI and speeding 95 mph in 45 mph zone. A summons was issued and he was released after 12-hour detoxification.

Antoine Wilkinson, 23, St. Joseph, was arrested Sept. 20 for misdemeanor no valid license. He posted $300 bond.

David Reyneros, 35, Ottumwa, Iowa, was arrested Sept. 16 for misdemeanor no valid license. He posted $500 bond.

Marty Goerne, 25, Jamesport, was arrested Sept. 20 for misdemeanor DWI and no valid license. He posted $1,500 bond.

Michele Wilson, 38, Jamesport, was arrested Sept. 20 for misdemeanor possession of marijuana, paraphernalia, and providing liquor to minors. She posted $1,500 bond.

Ryan Lunsford, 20, Wichita, Kan., was arrested Sept. 18 for misdemeanor possession of marijuana and paraphernalia. A summons was issued and he was released.

Associate Circuit Court

Brett W. Lang, Gallatin, was charged Sept. 17 with felony non-support.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $810.50 for 15 cases. The total fines assessed for defendants who reside in Missouri was $910.50 for 13 cases. Court costs collected for the State of Missouri amount to $58.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Colby O. Graham, Bethany, was fined $28.50 for vision reducing material and $10 for no seat belt.

Archie Morris, Kansas City, was fined $28.50 for speeding and $10 for no seat belt.
