James Lewis, bridge supervisor, reported that they will be installing metal culverts this week at various locations around the county.

Reta Rains, treasurer, submitted her monthly report requesting that the commission give her a list of any extra expenditures planned for the next six months.

A petition for the vacation of a road in section 27 of Harrison Township was read for the second time. The third and final reading will be in September. At that time a decision will be made.

The clerk submitted the 2009 assessed valuation of $103,732,894 for the county.

Dale Dickson, Shafer, Kline and Warren, met with the commission recommending that Copeland Development and Construction be awarded the contract for the electrical renovation at the courthouse. David Cox moved that the contracted be executed. Danny Heldenbrand seconded. The motion approved unanimously. Mr. Dickson will notify the contractor.

Ed Osby, Daviess County Nursing and Rehab, met with the commission and Dale Dickson, SKW, regarding the specifications of the window replacement. They also discussed the replacement of the boiler, condenser and chiller system.

A letter was received from the Daviess County Library Board with recommendations for filling two vacancies on the board. Danny Heldenbrand move to appoint Gregg Hartley to represent the Pattonsburg area and Kelvina Hobbs in the Jamesport area. David Cox seconded. The motion was approved unanimously. A letter of appointment was sent to the board.

In the afternoon, the commission inspected the property at 609 S. Main with adjacent landowners, in regard to the drainage problems. Everyone agreed to allow the commission to correct the drainage problem and to allow access on their property to do so.

The commission also inspected roads in Jefferson Township. Brush removal letters will be sent to landowners.

Bills were audited and paid.

These are the approved minutes of July 6, 2009. Lance Critten called the meeting to order. David Cox, First District Commissioner and Danny Heldenbrand, Second District Commissioner, were in attendance. Minutes were approved.

Circuit Court

Criminal cases filed: State vs. Billy B. Bonebrake, Jamesport, two counts of peace disturbance first offense, class B misdemeanor; unlawful use of weapon, class D felony, two counts; resisting arrest, class A misdemeanor; assault on law enforcement officer, class A misdemeanor; trespassing second degree, infraction.

State vs. Rebecca D. King, Gallatin, passing bad checks, two counts, class C felonies;

State vs. Nathan P. Allen, Gallatin, forcible rape, felony; sexual misconduct involving child under 15 first offense, class D felony.

State vs. Emery Bruce Smith, Odessa, resisting arrest for a felony, class D felony.

On July 8 before Judge Jason Kanoy, a release was granted to Karolis J. Laucevicius as a treatment program was successfully completed. He is on five years probation, with a suspended execution of sentence for 7 years in the Department of Corrections for possession of controlled substance

A warrant was issued for Cinthya M. Davis on July 13 for assault second degree, class C felony, and misdemeanor DWI.

Sheriff’s Office

Cinthya Davis, 34, Altamont, was arrested July 10 for assault third degree, class A misdemeanor, and posted $750 bond. Bond was later revoked on a charge of DWI and assault second degree. She is being held at the Daviess-DeKalb Regional Jail.

Robert Hunt, 48, Altamont, was charged July 11 with domestic assault second degree, class C felony. He posted $35,000 bond.

Jonathon Woods, 18, Trenton, was arrested July 14 for failure to appear on a misdemeanor charge of no valid license. He is being held on $600 bond.

Kurt Waterbury, 23, Jameson, was charged July 11 with misdemeanor harassment and posted $250 bond.

Tesla Davis, 18, Altamont, was arrested July 10 for assault third degree, class A misdemeanor. She posted $250 bond.

Martin Henn, 40, Fort Atkinson, Wis., was charged July 7 with possession of marijuana and paraphernalia. He posted $750 bond.

Richard W. Welch, 38, Jameson, was charged July 8 with domestic assault third degree, class A misdemeanor. He is being held on $1,000 bond.

Associate Circuit Court

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations and $116.50 in most criminal cases.

Brent A. Simmons, Kansas City, driving while suspended, 48 hours jail, board bill paid by defendant; speeding, $28.50.

Joshua C. Becerra, Shawnee, Kan., no valid license, $150; speeding, $58.50; no valid plates, $28.50.

Corey E. Carr, Marshall, possession of marijuana, prior offender, five days jail (board bill paid by defendant), abuse and lose order.

Jeffery D. Taylor, Altamont, no valid license, $150; no insurance, $103.50; illegally operated ATV on highway, $18.50.

Dustin M. Spangler, Kansas City, Kan., no valid license, prior offender, 15 days jail; possession of marijuana, 15 days jail consecutive; speeding, $58.50.

Jerry R. Gillum Braymer, resisting/interfering with arrest, one year jail, suspended execution of sentence, 2 years probation, 20 days shock jail, $25.

Margaret K. Blaha, Excelsior Springs, passing bad checks, $25.

The following case was heard by Judge James Valbracht: Lance D. Wilson, Gallatin, driving while intoxicated, three days jail, board bill paid by defendant.

Civil Court

Suit on account: Two cases were dismissed by the parties, Worldwide Asset vs. Debra Fisher and Pinnacle Credit vs. Chris Skinner.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,412.50 for 24 cases. The total fines assessed for defendants who reside in Missouri was $793 for 15 cases.
