A jury trial for John Craig First was set for June 11. Prior to the trial, Prosecutor Annie Gibson filed second amended information, and the defense filed a motion in limine. After considering these filings, Judge Brent Elliott declared a mistrial. The defendant then entered an Alford plea to the amended charge of child abuse, class C felony, and received a suspended imposition of sentence and five years probation. In a separate case for domestic assault, the court revoked the suspended imposition of sentence on a probation violation, and First was sentenced to 172 days in the county jail with credit for time served.
On June 11, Terry G. Spillman & Barbara D Smith vs. Sherry Whitt was dismissed by the court with prejudice.
Civil cases filed: Shelli Dawn Christopher, Gallatin, vs. Judd Martin Christopher, Kidder, dissolution of marriage; Cynthia Ann Rairden, Jameson, vs. Henry Lee Rairden Jr., dissolution of marriage; Tena Maillet, Gallatin, vs. Donald Maillet, Lakewood, Colo., dissolution of marriage; Metlife Home Loans vs. Matthew Allen, Hamilton, Joe Cockrum, Hamilton, and Patricia Tod Connie, Hamilton, declaratory judgment and replevin of property.
County Commission
James Lewis, bridge supervisor, reported that they are checking for damage from the storm and continuing to make repairs to bridges around the county this week.
Bob Burnett, Snyder and Associates, met with the commission with the final paperwork for BRO (29).
David Cox, Lance Critten, Mark Hemry and Jesse Bird went to BOE training on June 2 in Liberty.
Angie Kirshner with Access II met with the commission to let them know about damage to the building from the storm. She also informed the commission that they are planning on making a parking lot on the vacant lot next to the building that Access II owns, and they wanted permission to remove a tree that needs to be taken down for safety reasons.
Tim and Debbie Price met with the commission about the roads and ditches in Altamont not being maintained. The commissioners informed them that they do not have any authority over incorporated areas.
Tim Stoll with Liberty Mutual Life Insurance met with the commission regarding group term life policies and accidental death coverage.
The commission met Sheriff Ben Becerra at the storage unit in the afternoon to check over a roof leak.
Bills were audited and paid.

Civil Court
Breach of contract: A default judgment was entered for Harvest Credit Management VII LLC and against Ronald Day. Capital One Bank vs. Maureen A. Larson was dismissed by the parties.
Suit on account: A consent judgment was entered for Midwestern Health and against Nanette Burge. North Star vs. Julie Martin was dismissed by the court without prejudice.
Rent and possession: In Daniel Froman etal vs. Dan Rumley and Brandy Bills, the court found for the defendants Rumley and Bills.
Unlawful detainer: In Bank of New York Mellon vs. Mary Lou and William Browning etal, judgment was entered for possession of the property to the plaintiff.
Small Claims
A default judgment was entered for Conrad Carder and against Bill Caldwell.
Traffic Fines
The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $966.50 for 16 cases. The total fines assessed for defendants who reside in Missouri was $389.50 for 8 cases. Court costs collected for the State of Missouri amount to $58.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Marriage
Sterling Michael Silva and Shelly Kay Mayo, both of Stewartsville, were married June 9 by Judge Daren Adkins.
Sheriff’s Office
Harry Olsen, 22, Winston, was arrested June 15 for domestic assault 2nd degree, class C felony, and misdemeanor assault on law enforcement officer. Bond is set at $35,000.
Brett Olsen, 22, Winston, was arrested June 15 for driving while revoked and possession of marijuana and paraphernalia, all misdemeanors. Bond is set at $1,100.
Mike King, 20, Trenton, was arrested June 12 for a parole violation on an original charge of no valid license. He was returned to the Department of Corrections.
David J. Smith, 34, Carondolet, Ill., was arrested June 15 for failure to appear on a misdemeanor charge of no valid license. He posted $500 bond.
Emery Smith, 57, was arrested June 15 for probation and parole violations for felony no valid license, and bond was denied. On a felony charge of resisting arrest, bond was set at $15,000.
Mark Easter of Morrell Farms reported a theft at 21708 Nickel Ave., Gallatin, on June 11. Items taken included a BBQ grill, tools, wood flooring and a door.
