James Lewis, road and bridge supervisor, reported that they are applying rip rap to bridges and culverts.

Bills were audited and paid.

Bob Burnett, Snyder and Associates, met with the commission with pay estimates for BRO projects 30 and 31. He also delivered copies of donation letters, warranty deeds, the negotiator’s log for each parcel, and the right-of-way certification. David Cox moved to schedule BRO project 32 to replace bridge number 4270009 in Grand River Township with Snyder and Associates as consulting engineer. Danny Heldenbrand seconded. The motion was approved unanimously.

In the afternoon, the commission met with the Caldwell County Commission at a cooperative low-water crossing in Sheridan Township on the county line. Caldwell County will clean the crossing at no cost to Daviess County. They also inspected a bridge in Grand River Township.

These are the approved minutes of April 20, 2009. All commissioners were present. Minutes were approved.

Associate Circuit Court

Meckessa Rice-Mattox, Pattonsburg, was charged April 24 with passing bad checks, class C felony.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations, and $116.50 in most criminal cases. These cases were heard by Judge Daren Adkins.

Marty L. Goerne, Jamesport, probation violation on original charge of driving while intoxicated, probation revoked, two days jail.

Robert S. Fredricks, Pattonsburg, possession of paraphernalia, prior offender, two days jail; possession of marijuana, prior offender, five days jail, board bill paid by defendant.

Brett J. McKown, Rochester, Minn., possession of marijuana, two days jail, board bill paid by defendant; possession of paraphernalia, $150 fine.

Benjamin T. Helms, Gladstone, no valid license, 30 days jail, suspended execution of sentence, two years probation, two days shock jail, board bill paid by defendant; speeding, $28.50; no seat belt, $10.

Melissa A. Craig, Gallatin, no insurance, suspended imposition of sentence, two years probation, 30 hours community service.

Jerod B. Wade, Junction City, Kan., careless and imprudent driving amended to no accident, $38.50.

Melinda J. Swoyer, Mountain Home, Ark., driving while intoxicated, prior offender, five days jail, board bill paid by defendant.

Mitchell L. Flowers, Trenton, driving while intoxicated, $350 fine, one day jail, board bill paid by defendant.

Jeffrey S. Shanks, Winston, tag and checked deer taken by another, $154.

Moses W. Jonassen, Gallatin, probation violation on original charge of failure to signal, probation revoked, $28.50; no insurance, two days jail; careless and imprudent driving, 10 days jail consecutive; failure to yield to emergency vehicle, 10 days jail consecutive.

Moses W. Jonassen, Gallatin, assault on law enforcement officer, 30 days jail, consecutive, $25; resisting arrest, 30 days jail consecutive, $25; careless and imprudent driving, five days jail, consecutive, $10; resisting arrest, 10 days jail consecutive, $25.

Stephen B. Eddings, Kansas City, driving while revoked amended to no valid license, $150.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $529 for eight tickets. The total fines assessed for defendants who reside in Missouri was $189.50 for four cases. Court costs collected for the State of Missouri amount to $58.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Speeding: Ann M. Haffey, Bethany, $26.50; Brett E. Lawson, Trenton, $116.50.No Seat Belt: Kevin M. Jacobs, Milan, $10.

Failed to register motor vehicle with DOR: Melody A. McCleary, Kidder, $36.50.

Civil Court

Breach of contract: A default judgment was entered for Chrysler Financial Services and against Robert R. Gulley. A consent judgment was entered for Capital One Bank and against Stephen P. Allen. Two cases were dismissed by the court without prejudice, FIA Card Services vs. Julie M. Martin, and Atlantic Credit vs. Suzan Ely.

In Harold L. Johnson vs. Director of Revenue, petition for limited driving privileges, the case was transferred to Harrison County.

Sheriff’s Office

Elijah Knowles, 25, Pattonsburg, was arrested April 21 for felony and misdemeanor domestic assault. He posted $35,000 bond.

Margaret Jones, 43, Breckenridge, was charged April 22 with two felony counts of forgery. These charges are in addition to the forgery charges which were filed in March. She is being held on $35,000 bond.

Horacio Huerta, 33, Kansas City, was arrested April 22 for failure to appear on a misdemeanor charge of no valid license. He posted $1,000 bond.

Matthew Zimmer, 34, Whittier, Calif., was arrested April 22 for misdemeanor no valid license. He posted $500 bond.

Delbert Crossley, 50, Jamesport, was arrested April 25 for DWI, alcohol, persistent offender, class D felony, and misdemeanor no valid license. He is being held at the regional jail on $15,000 bond.

Circuit Court

The following cases were heard by Judge Brent Elliott:

On April 23, in Orville Lee Grimes vs. Judith Grimes etal, the court found all issues in favor of the defendants. Costs were taxed to the plaintiff.

A warrant was issued April 27 for the arrest of Stephen W. Sandoval for a probation violation on an original charge of possession of controlled substance. He is to be held without bond pending a revocation hearing.

A warrant was issued April 27 for the arrest of Dell T. Chapman Jr. For a probation violation on an original charge of possession of controlled substance. He is to be held without bond pending a revocation hearing.

A dissolution of marriage was granted to Amanda Moreno from John Moreno on April 24, with her maiden name Humphreys restored.

Before Judge Warren McElwain on April 21, Dustin R. Esterline received an amended sentence of three years, as the six-year sentence exceeded the maximum sentence provided by law for a class D felony. Esterline admitted probation violations, and his probation was revoked. He was committed to the Department of Corrections for a term of three years. The original charge was operating a motorcycle when license not validated for such operation, third and subsequent offense, class D felony.

Before Judge Daren Adkins on April 27, Joe Willie Huff plead guilty to two counts of non-support, class D felonies. Sentence assessment report was waived. He was sentenced to four years in the Department of Corrections, execution of sentence suspended, and received five years probation on each of the two counts, sentences to run consecutively. He is also to serve 30 days shock time in the regional jail.
