County Commission
James Lewis, bridge supervisor, reported that they will continue routine repairs this week.
The commission audited and paid bills. They also reviewed the quarterly comparisons of budget to actual revenues and expenses.
Harry Roberts, agent, met with the commission regarding the employee health insurance. A contract with Community Health was signed for the 2009 renewal.
The commission read a petition for the vacation of a public road in section 27 of Harrison Township for the first time. Three copies were given to Ben Becerra, sheriff, for posting at three intersections since there is no public building.
The commission signed a proclamation regarding impediments to fair housing choice. This proclamation is a requirement of Community Development Block Grant funding.
Roy Hazzard, Monroe Township, met with the commission questioning the status of a road on the county line. Caldwell County is responsible for maintenance of the east end of CART road 160.
In the afternoon, the commission met with the engineer, landowners, and interested parties involved with BRO 30 at the site. All landowners verbally agreed to sign the deeds.
The Commission contacted Worrell Construction to make some waterproofing improvements at the property at 609 South Main.

Sheriff’s Office
Juan Antonion Tanco-Baez, 23, Ottumwa, Iowa, was arrested April 8 for misdemeanor no valid license. He posted $500 bond.
Danny Gingerich, 41, Jamesport, was arrested April 12 for misdemeanor DWI. He was processed and released, and a summons was issued.
Martha Schapeler, 53, St. Joseph, was arrested April 12 for misdemeanor DWI. She was held for 12-hour detoxification. She was processed and released to Sullivan County on a warrant for misdemeanor shoplifting, with bond of $250.
Associate Circuit Court
Felony non-support charges have been filed against Thomas M. Merrigan, Jameson, one count; Victoria L. Griffith, Chester, Ill., one count; and Cindy D. Beech, Portland, Ore., three counts.
Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $68.50 for moving traffic violations, and $116.50 in most criminal cases.

Civil Court
Breach of contract: Two default judgments were entered for Capital One Bank and against Judith D. Mansil. A change of venue to Harrison County was granted in Harrison County Hospital vs. John and Jean Stieh.
Suits on account: Default judgments were entered for LVNV Funding LLC and against Max L. Courter; for North Star Capital Acquisition and against Charles Malo; and for Worldwide Asset Purchasing II and against Angela Wayne. Two cases were dismissed by parties, Midwestern Health vs. Jennifer Dickson and Discover Bank vs. Matt Argyle.
Traffic Fines
The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,189 for 18 tickets. The total fines assessed for defendants who reside in Missouri was $1609.50 for 19 cases. Court costs collected for the State of Missouri amount to $58.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Circuit Court
Criminal Law Day was conducted April 9 by Judge Brent Elliott. The following cases were heard:
Jason Robert Warren received five years for tampering with motor vehicle and two years for resisting arrest, sentences to run concurrently.
Joshua Jade Collier was sentenced to five years for possession of chemical with intent to manufacture; two years for possession of any methamphetamine precursor drug with intent to manufacture; two years for unlawful use of paraphernalia, felony; 10 days in the regional jail for misdemeanor paraphernalia; and 30 days in the regional jail for possession of marijuana, all sentences to run concurrently.
Roger W. Roedel received a fine of $5,000 plus costs for felony property damage first degree. He had previously been found guilty by a jury trial.
Byron King had received a suspended imposition of sentence for assault second degree. After admitting probation violations, he was sentenced to five years in the Department of Corrections.
Larry A. Funk admitted probation violations. His probation was revoked and he was sentenced to seven years in the Department of Corrections for possession of a controlled substance.
Probation was revoked for Jaime L. Odom on a felony charge of possession of controlled substance and two misdemeanor counts of domestic assault. The five year sentence previously imposed for the possession charge was ordered executed. He was also sentenced to one year in the regional jail and 10 days in the regional jail on the assault charges, sentences to run consecutively. The one-year sentence will run concurrently with the five-year sentence in the Department of Corrections. The 10-day sentence will run consecutively to the five-year sentence.
A jury trial was set for July 13 for Celinda A. Rogers on a class C felony charge of theft/stealing.
David F. Wiglesworth was arrested for a probation violation on an original charge of felony passing bad checks.
Raymond F. Morris admitted probation violations on a charge of no valid license third and subsequent offense. He was continued on probation, with the term of the probation extended two years.
State vs. Dustin R. Esterline was ordered transferred to the presiding circuit judge for assignment, on a felony charge of operating motorcycle with license not validated for such operation, third and subsequent offense.
In State vs. Margaret Jones, a motion for change of judge was sustained and the case was transferred to the presiding circuit judge for reassignment. The charges are two counts of felony forgery.
In State vs. Caleb A. Blomberg, the case was transferred to the presiding circuit judge for reassignment. Charges are possession with intent to distribute a controlled substance, class B felony; unlawful use of drug paraphernalia, class A misdemeanor; cut in on overtaken vehicle, class C misdemeanor; no valid license, class A misdemeanor.
In State vs. Bryceston L. Flathers, the case was transferred to the presiding circuit judge for reappointment. The charge is felony possession of controlled substance.
A warrant was issued for the arrest of Shelley R. Birmingham for alleged probation violations. She was ordered held without bond. The original charge is misdemeanor passing bad checks.
On April 13, a warrant was issued for the arrest of Shelah J. Breault on original charges of felony burglary second degree and forgery. Bond was denied.
Civil Law Day was conducted April 7 by Judge Brent Elliott. The following cases were heard:
