Notification was received from Health Systems, Inc., of their intentions to discontinue the management of the Lake Viking Care Center. David Cox moved to abate the lease payments, as scheduled and agreed to in the lease agreement with N&R of Gallatin, Inc., assuring their services through March 31. The motion was approved unanimously.
James Lewis, bridge supervisor, reported that they are making culvert and bridge repairs as weather permits.
Bob Burnett, Snyder and Associates, met with the commission submitting change orders and progress invoices for BRO project 29. They also discussed the delays with property owners in obtaining rights-of-way for projects 30 and 31.
At 10 a.m., as advertised, the commission held the final public hearing for the 2009 budget. No one from the public attended. The commission reviewed the final budget. The budget was unanimously approved. The appropriation order was executed. One copy will be submitted to the State Auditor’s office, one copy to the Treasurer’s office, and one copy retained as permanent record.
The Commission inspected roads in Colfax Township.
Martin Liles, MoDOT, met with the commission for introductory purposes. He reported on the "Safe and Sound" promotion for 800 bridge replacements statewide over the next five years. Fourteen of the bridges are located in Daviess County.
Ben Becerra, sheriff, met with the commission regarding budgets and vehicle repairs.

Sheriff’s Office
Dean Lawson reported Jan. 23 that nine cows and heifers had been stolen from his pasture located at Lincoln and Grand Street in Winston. After feeding the cattle on Jan. 20, Lawson returned to find the gates open and his cattle out. After putting the cattle back in the pasture, he found nine head missing. It is believed suspect(s) backed up to the double gates and loaded the cattle. The loss is estimated at $900-$1000 per head.
Jeffery Allan Brandon, 46, was charged Jan. 29 with possession of controlled substance with intent to distribute, class B felony. Brandon was stopped on I-35 for an expired Michigan registration. During the traffic stop, Sgt. Larry M. Allen observed bundles of contraband in plain view. Brandon is being held on $75,000 bond.
Brandon Jones, 24, Gallatin, was arrested Jan. 26 on probation violations for two counts of felony non-support and for failure to appear on a misdemeanor count of peace disturbance. He is being held on $50,250 bond.
Jason Nelson, 31, Cameron, was arrested Jan. 31 for failure to appear on a misdemeanor traffic violation. He posted $170 bond.
Walter Hudson, 25, St. Paul, Minn., was arrested Jan. 31 for failure to appear on a misdemeanor charge of no valid license. He posted $1,000 bond.
Robert T. Wilson, 45, Jamesport, was arrested Jan. 27 for failure to appear on a misdemeanor charge of property damage. He posted $1,100 bond.
Ronald Brown, 38, Lebanon, was arrested Jan. 30 on Boone County warrants for misdemeanor traffic violations. He posted $127.50 bond.
Associate Circuit Court
One charge of felony theft was filed against Jimmy Don Gilley of DeQueen, Ark., on Jan. 29.
Civil Court
Suits on Account: Default judgments were entered for Capital One Bank and against Lynn M. Brown, for Midwestern Health and against James D. Reid, and for Midwestern Health and against Marsha Robb. Midwestern Health vs. Douglas and Angel Michael was dismissed by the parties.
In Velocity Investment vs. Max L. Courter, the arbitration award was confirmed as a judgment in favor of the plaintiffs.
Circuit Court
A dissolution of marriage was granted Jan. 12, 2009, to Crystal Lamm from Jeremy Lamm by Judge Daren Adkins.
A warrant was issued on Feb. 3 for the arrest of Karolis J. Laucevicius for alleged probation violation of using controlled substances. He was ordered held without bond.
