County Commission

James Lewis, bridge supervisor, reported that they have ten additional FEMA tubes to install on dirt roads as weather permits. Also, they will make repairs on board bridges this week.

Bills were audited and paid.

Jerry and Mary Harris, janitors, met with the commission regarding problems in the public restrooms.

A request was made to add 0.4 mile on the section line of 3 and 34 in Salem Township to the CART program in 2009. Improvements were made by the public supply water district.

A contract was executed with MFA Oil Company for the Sheriff’s department fuel. The contract is for 600 gallons unleaded fuel per month at $1.74 for six months.

The commission contacted Tom Hudspeth, Lake Viking Care Center, regarding their lease.

Zac Johnson, Gallatin city administrator, and Steve Reid met with the commission regarding the addition of generators to the county inventory for emergencies. The commission was advised that a generator would not always be compatible with a commercial building because of the voltage. Generators would have to be site specific.

Scott Krieger with Marceline Mapping met with the commission regarding GIS mapping.

These are the approved minutes of Dec. 8, 2008. All commissioners were present, as well as David Cox, commissioner-elect.

Sheriff’s Office

Dan Bontrager of the Bontrager Shop on Highway RA, Jamesport, reported the theft of four chainsaws from his shop on Dec. 10. Nothing else was disturbed. It appeared that two suspects gained entry through the back door.

On Dec. 13, Brian Lasher, 35, Tyler D. Nichols, 23, and Sally Gray, 52, all of Gallatin, were each charged with misdemeanor DWI. Lasher and Nichols posted $500 bond. Gray was held 12 hours, processed and released with a summons issued.

Associate Circuit Court

Richard W. Gibson was charged Dec. 11 with three felonies, unlawful use of a weapon, unlawful possession of a firearm, and resisting arrest.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. The cases were heard by Judge Daren Adkins. Court costs collected for the State of Missouri amount to $66.50 for moving traffic violations and $114.50 in most criminal cases.

Failed to tag deer: Keith W. Boyd, St. Louis, $100; Daniel L. Tullman, Ballwin, $100; David W. Glassbrenner, St. Louis, $100.

Filed to check deer on day taken: Destry Balch, Minersville, $100.

Illegal possession of wildlife or parts therof: Rodney G. Julander, Layton, Utah, $15.

Speeding: Kevin J. Isom, Parkview, $500.

Performed improper vehicle inspection: Jacob Cameron, Winston, $50.

Minor in possession of alcohol probation violation: Trevor W. Hunter, Coffey, probation revoked, 14 days jail.

Peace disturbance: Michael C. Keatley, Blythedale, 48 hours jail.

Take bobcat during closed season: Carl E. Miller, Jamesport, $133.

Probation was revoked for Gerald Anderson, Buckner, on a probation violation for assault. He received 10 days in jail.

Steven D. Lockridge, Jamesport, was fined $350 for driving while intoxicated and $38.50 for failure to drive on right half of roadway.

Merino M. Maldonado, St. Joseph was fined $150 for no valid license and $28.50 for failure to equip vehicle with tail lamps and no seat belt.

Tara R. Robb, Jamesport, received two days jail for domestic assault, two days jail for resisting arrest, and two days jail for assault of police officer. Board bills paid by defendant.

Anthony L. Bowe, Thornton, Colo., received 48 hours jail for possession of marijuana and was fined $88.50 for speeding.

Eric Crose, Kansas City, Kan., received one year in jail, suspended execution of sentence, and two years probation for sexual offender failure to notify of change of address. He was fined $150 for no valid license.

Tracy L. Carder, Gallatin, received a suspended imposition of sentence, two years probation, and 40 hours community service for DWI and was fined $18.50 for failure to display lighted lamps.

In a case heard by Judge Jason Kanoy, Brandon L. Robb, Jamesport, received a suspended imposition of sentence, two years probation, and 40 hours community service for domestic assault.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $840.50 for 15 tickets. The total fines assessed for defendants who reside in Missouri was $441 for eight cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Speeding: Jason L. Ham, Kansas City, $88.50; Dale R. Eaton, St. Joseph, $58.50; Dylan T. Carter, Columbia, $58.50; Gene Erickson, Maysville, $28.50.

No seat belt: Nicole L. Albrecht, Gallatin, $10; Travis E. Wood, Trenton, $10.

Failure to yield: David R. Lucasen, Winston, $38.50.

Failed to yield right of way for emergency vehicles: Garold L. Walker, Altamont, $148.50.

Civil Court

Breach of contract: Capital One Bank vs. Ronda Norton was dismissed by the parties. A default judgment was entered for The New Liberty Hospital and against Andrea L. Vestal.

Small Claims

A consent judgment was entered for Farmers Bank and against Tim C. and Nanette Burge.

Circuit Court

The jury trial scheduled Dec. 18 for James L. Gause on three counts of statutory rape was canceled, and a plea hearing was set for Jan. 21, 2009.

Law Day proceedings were conducted Dec. 16 by Judge Warren McElwain. The following case was heard, and additional cases will be reported in next week’s edition.

Daniel V. Williams plead guilty to an amended class A misdemeanor charge of receiving stolen property, based on a plea agreement. The imposition of sentence was suspended and he received two years probation, with conditions to include serving 10 days shock probation in the regional jail.

A dissolution of marriage was granted to Gayla Doreen Teel from Donald Rex Tell on Dec. 11.
