James Lewis, bridge supervisor, reported that flood damage is still being repaired.

Dick Carpenter, Harrison Township, met with the commission regarding road problems in that township.

Harrington and Cortelyou Engineering contacted the commission regarding bridge number 1860006. If minor repairs are made, the load limit will be increased to 11 tons. The bridge was recently closed by state inspectors.

A representative of Vision Care Direct met with the commission and department heads regarding a supplemental vision plan for employees at their own cost.

At noon, the commission attended the Local Emergency Planning Commission meeting at the Daviess County Healthy Office.

These are the approved minutes of July 21, 2008. All commissioners were present.

County Clerk

The county clerk’s office will be open on Saturday, Aug. 2 until noon for those casting absentee ballots. The office is also available for absentee balloting during regular business hours or by appointment.

Assessor’s Office

Representatives from the assessor’s office will be working in the field during the next few months, reviewing property for the 2009 reassessment.

Sheriff’s Department

John C. First, 35, Gallatin, was charged July 23 with two felony counts of abuse of child. Bond was set at $5,000. He is also being held for probation violations on an original charge of domestic assault, with a $20,000 bond.

Valerie Edenfield, 44, Atkinson, Ill., was arrested July 24 during a traffic stop on I-35 for possession of controlled substance (methamphetamine), class C felony. She is being held on $35,000 bond.

Janellda Sue Weber, 48, Coffey, was arrested July 23 for attempted delivery of a controlled substance to a correctional facility, class C felony, during a traffic stop on I-35. The sheriff’s department and Highway Patrol, acting upon information that Weber might be smuggling marijuana into the Department of Corrections, made the traffic stop when she failed to stop at the posted stop sign on the off ramp of I-35 and Missouri Route C. Ms. Weber consented to a search of the vehicle, in which 28 grams of marijuana was discovered. She admitted that she was going to take it into the Department of Corrections at 3 a.m. on July 24. She posted $15,000 bond.

Rose Lampman, 51, and Michael Allen, 57, both of Des Moines, Iowa, were arrested July 26 for misdemeanor possession of marijuana. They each posted $500 bond.

Ron Kregel of Weatherby reported July 24 that property owned by Kenneth H. Jenkins of Liberty, which is located on Midway Avenue in Daviess County, had been burglarized. Kregel had discovered two kids at the residence on July 24. They left in a gold car. Then Kregel found that the back screen door was broken. The owner, Kenneth Jenkins, was then called to the residence. Items found to be missing were liquor, binoculars, cutlery knives, a microwave, and two flashlights from a pickup truck.

Associate Circuit Court

Roger W. Roedel, Pattonsburg, was charged July 22 with property damage first degree, class D felony.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $943 for 18 tickets. The total fines assessed for defendants who reside in Missouri was $842 for 19 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Vision reducing material: Trent R. Church, Riverside, $28.50.

Failure to stop at stop sign: Shelby L. Hall, Kirksville, $28.50.

Speeding amended to defective brakes: Martin A. Zimmerman, Weatherby, $193.50.

Michael B. Russell, Jamesport, was fined $18.50 for no valid plate and $10 for no seat belt.

Civil Court

Breach of Contract: A consent judgment was entered for Capital One and against Paul G. Hurla.

Small Claims

A default judgment was entered for Home Exchange Bank and against Christopher C. Eason.

Marriage

Brian Scott Johnson and Megan Renee Love, both of Gallatin, were married July 25 by Judge Daren Adkins.

Circuit Court

Law Day proceedings were conducted July 22 by Judge Warren McElwain. Some cases were postponed and heard on July 25. The following is a partial listing of the cases that were heard. Additional cases will be reported next week.

A jury trial has been set Nov. 18, 2008, for Mark Romesburg on the class D felony charge of operating vehicle without valid licenses, third and subsequent offense.

A jury trial was set for Sept. 17, 2008, for Crystal McLain. She is charged with two counts of endangering the welfare of a child first degree, class C felony, two counts of statutory rape, class C felony, and one count of statutory sodomy, class C felony.

A jury trial was set for Dec. 10-11, 2008, for Karen "Toni" Fordyce on five counts of theft/stealing, class C felony.

A jury trial was set for Aug. 13, 2008, for Amanda Hodges. She is charged with possession with intent to distribute, class B felony, and endangering the welfare of a child first degree, class C felony.

Jeremy Ripple was sentenced to one year in the regional jail, execution of sentence suspended, on an amended charge of endangering the welfare of a child second degree, class A misdemeanor. He was placed on two years probation and ordered to serve 15 days shock probation, with credit for time served.

Donna Jean Blacketer plead guilty to possession of a controlled substance, class C felony, and no valid license, class A misdemeanor, based on a plea agreement. One count was dismissed. A sentence assessment report was ordered.

Andrew McBroom was sentenced to six years in the Department of Corrections on each of four class C felony charges, burglary second degree, stealing motor vehicle, theft/steal any credit card, and tampering, sentences to run concurrently. The execution of sentence was suspended, and he was placed on five years probation, with conditions to include 40 days shock probation, with credit for time served.

Jamie L. Scott admitted probation violations on the class C felony charge of possession of controlled substance. Probation was continued with the additional condition of completing the Women’s Recovery Center Program.

Probation was revoked for James A. Waggoner, and he was sentenced to four years in the Department of Corrections. The court retains jurisdiction and recommends institutional treatment. The charge was operating motor vehicle without valid license, class D felony.

Bryan C. Thomas was sentenced to four years in the Department of Corrections for operating motor vehicle without valid license, third and subsequent offense, class D felony. The court retains jurisdiction and recommends institutional treatment.

Joseph D. Omeara plead guilty to possession of a controlled substance while operating motor vehicle, class C felony, possession while operating vehicle, class A misdemeanor, and operating vehicle while driver’s license revoked, class A misdemeanor. A sentence assessment report was ordered.

Probation was continued for Gerald T. Franks on a class C felony charge of possession of controlled substance, with the additional condition of serving 30 days shock time in the regional jail.

Ruben F. Fierros received a suspended imposition of sentence and five years probation for possession of controlled substance, class C felony. He was ordered to serve 90 days shock probation in the regional jail, with credit for time served.

Stephen D. McQuinn plead guilty to burglary second degree, class C felony, and property damage second degree, class B misdemeanor, based on a plea agreement. A sentence assessment report was ordered.

Brigette L. Callaway plead guilty to the class C felony of possession of controlled substance, based on a plea agreement. She waived the sentence assessment report, and was sentenced to five years in the Department of Corrections, execution of sentence suspended. She received five years probation, with special conditions including five days shock probation in the regional jail and 100 hours public service work.

Porter D. Fensel received a suspended imposition of sentence and five years probation for the class C felony of possession of controlled substance. Conditions include 90 days shock probation in the regional jail, with credit for time served.

Michael L. King was sentenced to three years in the Department of Corrections, execution of sentence suspended. He received five years probation, with special conditions to include serving 30 days shock probation in the regional jail, with credit for time served.

Robert T. Wilson plead guilty to two counts of domestic assault third degree, class A misdemeanor. A sentence assessment report was ordered.

Michael P. Luzar plead guilty to possession of controlled substance while operating vehicle, class C felony, and operating motor vehicle without valid license, class A misdemeanor. A sentence assessment report was ordered.

The following non-support cases were heard July 23 by Judge Daren Adkins:

Rex Hagan received a suspended imposition of sentence and five years probation.

A warrant was issued for Brandon S. Jones, who failed to appear for a probation violation hearing on two counts of non-support. Bond was set at $25,000 on each count.

Probation was revoked for Christopher D. Tustison on two counts of non-support, and the previously imposed sentence of four years in the Department of Corrections on each count was ordered executed, sentences to run consecutively.
