James Lewis, bridge supervisor, met with the commission reporting that flood damage is being repaired. The site count is now up to 86. The Governor has declared the county a disaster area for public assistance.

Bills were audited and paid.

Craig Woolridge met with the commission with questions regarding the closing of a road in Sheridan Township. He was given a petition form.

Kevin Heldenbrand, sheriff, met with the commission regarding law enforcement matters.

The commission discussed the Local Emergency Planning Commission’s application for two grant funds. The commission will complete both applications.

At 1:20 p.m. the commission adjourned to meet as Board of Equalization. Those representing the county in addition to the commission were Mark Hemry and Jesse Bird as citizen members of the board, and Betty Harmison, assessor.

The Board of Equalization did not lower the assessment for Chester Smith. He will appeal to the State Tax Commission.

The commission re-convened.

Lake Viking Care Center filed its monthly census report for the month of June at 26.9.

County Clerk

The office of County Clerk Linda Steward is open for absentee balloting during regular hours. The clerk’s office will also be open Saturday, Aug. 2 until noon for absentee balloting, or by appointment.

Sheriff’s Office

Rebecca Kramer of Yoder and Kramer Market on NN Highway in Jamesport reported that a white male took approximately $600 in cash and checks from the cash register on July 19. She and another employee were searching in the back room for an item that he requested. The man was described as being around 5-6, weighing around 300 pounds, and driving a newer four-door white/grey pickup. The case is under investigation.

Victoria Esterline, 27, Winston, was charged July 16 with forgery, class C felony, and theft/stealing, class A misdemeanor. The charges are in connection with the theft and forgery of a U.S. Treasury check belonging to Shanda and David Anderson. Esterline posted $35,000 bond.

Cary L. Syrdale, 36, Peoria Heights, Ill., was arrested July 15 for misdemeanor DWI, possession of marijuana and paraphernalia, and posted $1,250 bond.

Trisure Perez, 18, Minneapolis, Minn., was arrested July 19 for driving without valid license and posted $500 bond.

Jonathan McKinny, 25, Milan, was arrested July 18 for misdemeanor DWI.

Angela Tustison, 30, Cameron, was arrested July 20 for misdemeanor possession of marijuana and paraphernalia. She posted $750 bond.

Associate Circuit Court

Michael D. Little, Independence, was charged July 17 with two counts of non-support, class C felony.

Stephanie Gibson, 29, Jamesport, was charged July 16 with 16 counts of forgery, class C felony. She was in custody, as reported last week, for burglary, stealing, and Grundy County probation violations.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,224.50 for 22 tickets. The total fines assessed for defendants who reside in Missouri was $807 for 10 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Failure to register vehicle: Wendell C. Roberts, Pattonsburg, $38.50; Nicholas N. Roberts, Pattonsburg, $38.50.

Front seat passenger no seat belt: Kirsty L. Stephan, Pleasant Valley, $10.

Failure to secure child 8 years or younger: Sandra K. Booth, Pattonsburg, $30.

Speeding amended to defective brakes: Travis N. Toney, Gallatin, $143.50; Katherine L. Hoy, Kearney, $199.50; James L. Hoovens, Springfield, $200.

Speeding: Ty L. Wilson, Altamont, $28.50; Michelle L. Malone, Jameson, $88.50.

Child under 16 not wearing seat belt: Tracy D. Schartz, Jamesport, $30.

Civil Court

Suits on account: A consent judgment was entered for Cox Medical Centers and against Lanny and Tammy Morrow. Asset Acceptance LLC vs. Stacey C. Lewis was dismissed by the parties.

Rent and Possession: A consent judgment was entered for Aljend Properties LLC and against Rita and Jareld Curtis.

Small Claims

Farmers Bank vs. John Wayne Chance was dismissed by the parties.

Marriage

Fredy Antonio Lemus and Marcela Cuevas Quiroz, both of Winston, were married July 18, 2008, by Judge Daren Adkins.

Circuit Court

Results from Law Day proceedings held July 22 will be reported next week.

In a jury trial on July 18, Howard D. Johnson was found guilty of driving without a valid license and possession of controlled substance. The jury assessed the punishment for the first count at two weeks imprisonment in the county jail. On the second count, the jury assessed a punishment of one year in the county jail. The case has been continued to July 25 for final disposition and formal sentencing.

Tracey L. Huitt, Gallatin, plead guilty July 15 to possession of a controlled substance, class C felony, based on a plea agreement. The sentence assessment report was waived. Imposition of sentence was suspended, and defendant was placed on five years probation, 30 days of shock probation, credit given for time served.

A jury trial was set for Oct. 30, 2008, in a personal injury-vehicular case. The parties are Kathleen Wilcox as next friend for plaintiff Savannah Wilcox, both of Des Moines, vs. Dean Burton, Kansas City.
