County Commission

James Lewis, bridge supervisor, reported that they continue to make repairs on equipment. They are also disposing of old furniture discarded by officeholders.

Bills were audited and paid.

The commission met with Bo Harris regarding her duties in the courthouse.

Notification was received of a vacancy in the office of trustee for Grand River Township. Ruth Lewis was unanimously appointed trustee of Grand River Township.

An agreement with the Region H Hazardous Materials Response Team was executed for 2008.

The commission discussed the Alltel plan for the cell phones in the sheriff’s office with Tracy Sims, dispatcher.

Sheriff’s Department

Michael Persinger, 28, Kansas City, was arrested Feb. 8 for failure to appear on a misdemeanor charge of no valid license. He posted $600 bond.

Brandon Archer, 20, Winston, was arrested Feb. 11 for failure to appear on a misdemeanor charge of resisting arrest. He is being held on $500 bond.

Circuit Court

Criminal cases filed: State vs. Daniel M. Wendt, Polo, 35 counts of passing bad checks, class C felony; State vs. Kevin L. Baker, Trenton, operating vehicle without valid license, class D felony, failure to drive on right half of roadway, infraction, and littering, class A misdemeanor;

State vs. Corey M. Boyd, burglary second degree, class C felony, theft/stealing, class A misdemeanor, stealing motor vehicle, class C felony, tamper with motor vehicle first degree, class C felony, property damage first degree, class D felony, receiving stolen property, class C felony.

Civil cases filed: Edwin L. White, Osborn, vs. Larry and Randy Brammer, Chillicothe, mechanic’s lien.

Ashley Guerber of Bethany admitted probation violations on Jan. 22, and her probation was revoked. For felony burglary 2^nd degree, she received three years in the Department of Corrections. On two misdemeanor charges, property damage second degree and theft/stealing, she was sentenced to 30 days in the regional jail on each count, with credit for time served.

Associate Circuit

Paula Delp was charged Feb. 6 with passing bad checks, class C felony.

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $66.50 for moving traffic violations and $114.50 in most criminal cases.

Chad R. Cole, Gilman City, driving while suspended amended to no valid license, $150.

Trevor W. Hunter, Coffey, possess over limit of rabbits, $90.

Jason D. Holmes, Coffey, driving while intoxicated, suspended imposition of sentence, two years probation, supervised, one day shock jail, (board bill paid by defendant), ignition interlock order; endangering welfare of child, suspended imposition of sentence, two years probation.

Joshua D. Baumunk, Grimes, Iowa, possession of marijuana, 48 hours jail (board bill paid by defendant); possession of paraphernalia, $150.

Joseph A. Struska, Watertown, Iowa, speeding 118 mph in 70 mph zone, 48 hours jail (board bill paid by defendant, $250.

Daniel p. Kurtz, Jamesport, no valid license, $150; resisting arrest, 48 hours jail (board bill paid by defendant); operate ATV on highway, $18.50; careless and imprudent driving, $48.50; operated unregistered ATV, $28.50; failure to stop at stop sign, $28.50.

Greyson H. Green, Gallatin, no valid license, $150; failure to register, $28.50.

Robyn N. Shipers, Pattonsburg, failure to stop minor from drinking/possessing liquor, suspended imposition of sentence, two years probation, 30 hours community service.

Cassie R. Brown, Bethany, minor in possession of liquor, suspended imposition of sentence, two years probation, 30 hours community service.

Gary T. Davis, Cameron, probation violation on original charge of endangering welfare of child, probation continued with an additional one year of probation.

Martinez Edwards, Kansas City, possession of marijuana, 48 hours shock jail (board bill paid by defendant), suspended imposition of sentence, two years probation; possession of paraphernalia, suspended imposition of sentence, two years probation, 30 hours community service; vision reducing material, $28.50.

Danny J. Bright, East Prairie, attempt to take deer with artificial light, $250 fine, hunting license revoked for one year.

Eleanor L. Tatro, Kearney, possession of marijuana, 15 days jail, $25 fine; possession of paraphernalia, 15 days jail, concurrent, $25 fine.

Duste D. Harper, Kidder, passing bad checks, $25.

Alton J. Hostetler, Jamesport, taking raccoons with the aid of artificial light without the aid of a dog, $94.

Christopher W. Smith, Trenton, driving while intoxicated, (prior offender), six months jail, suspended execution of sentence, two years probation, 10 days shock jail (board bill paid by defendant), attend AA weekly, abuse and lose order.

Adnan Tabokovic, St. Louis, no valid license, $150; speeding 105 in 70 mph zone, 48 hours jail (board bill paid by defendant), $250 fine.

Robert O. Dahl, Ridgeway, driving while revoked amended to no valid license, 48 hours jail (board bill paid by defendant; no insurance, $103.50.

Robert W. Rosenbaum, Jamesport, driving while intoxicated, suspended imposition of sentence, two years probation, abuse and lose order; minor in possession of liquor, suspended imposition of sentence, two years probation, 30 hours community service.

Justin S. Meals, St. Joseph, driving while revoked amended to no valid license, $150.

The following case was heard by Judge James Valbracht: Michael J. Weber, Coffey, driving while intoxicated, $350 fine.

Municipal Division

Courts costs for moving violation $32.50; non-moving $29.50.

Daniel V. Williams, Gallatin, careless and imprudent, $47.50; no flag on ATV, $7.50.

Cassandra A. Leatherman, Gallatin, dog at large, $10.50.

Carla J. Craig, Cameron, animal neglect, $100; no city tags, $10.50.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $553 for eight tickets. The total fines assessed for defendants who reside in Missouri was $1793.50 for 24 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Failure to display valid plates: Arthur H. Wieand, Pattonsburg, $18.50.

Jonathan C. Stephenson, Gallatin, was fined $103.50 for no insurance and $78.50 for displaying plates of another.

Rita M. Bryant, Princeton, was fined $58.50 for speeding and $38.50 for failure to display valid plates.

Valencia Silas, St. Louis, was fined $148.50 for speeding and $10 for no seat belt.

Small Claims

The following cases were dismissed by the parties: City of Gallatin vs. Max and Beverly Berry; City of Gallatin vs. Lisa Kay Dickson; City of Gallatin vs. Dennis and Nicole Lund; City of Gallatin vs. Rob and Shari Troyer.

Default judgments were entered as follows: for City of Gallatin and against Lori Johnson; for City of Gallatin and against John and Shawn Pettit; for City of Gallatin and against Greg Worthy.
