Sheriff’s Office
Two subjects were arrested on D Highway near Vista Avenue by Deputy Philip Berry on Jan. 23, following reports to the Daviess County 9-1-1 dispatcher concerning a burglary that occurred on State Highway D at the home of Leonardo Bottroff, and a report of tampering with a vehicle on 185th Street, as reported by the owner of the car, Lorra Johnson.
The two subjects, one male and one female, were spotted by Deputy Berry when they walked out of the woods to sit on the highway.
Jaime Lynn Rinehart, 31, Jamesport, and Cory M. Boyd, 22, were each charged with burglary second degree, class C felony, theft/stealing, class A misdemeanor, stealing a motor vehicle, class C felony, tampering with motor vehicle first degree, class C felony, property damage first degree, class D felony, and receiving stolen property, class C felony.
During questioning, according to the probable cause statement, Rinehart stated that they had stolen a Honda Accord in Kansas City that morning in order to get to Jamesport to see her mother. They abandoned the Honda on 180th Street about one mile north of Highway D when the car got stuck. They then tried to steal a Buick on 185th Street until the owner Lorra Johnson chased them away. At that point they went to the neighbor’s, Leonardo Bottroff, where they took some change, jewelry and cigarettes which they later threw into the woods.
They are each being held on $75,000 bond.
In a traffic stop on I-35 on Jan. 24, Luiz Fernandes, 30, Irving, Texas, was arrested for possession of controlled substance, methamphetamine, class C felony, as well as misdemeanor failure to display plates. He is being held on $35,000 bond.
Walter R. Price, 28, St. Joseph, was arrested Jan. 23, charged with felony no valid license. He posted $1,000 bond.
Terry Huston, 41, Kansas City, was charged Jan. 23 with failure to appear on a misdemeanor charge of driving while revoked. He is being held on $1,000 bond.
Francisco Rodriguez, 66, Kansas City, was arrested Jan. 24 for misdemeanor no valid license. He posted $350 bond.
Michael King, 28, Jamesport, was charged Jan. 25 with failure to appear on a felony no valid license charge. He is being held on $5,000 bond.
A break-in occurred Jan. 23 at Premium Standard Farms, Hickory Creek #1, on 225th Street. Medication valued at over $3,500 was taken.
County Commission
James Lewis, bridge supervisor, reported that they continue to make repairs on equipment.
Bob Burnett, Snyder and Associates, met with the commissioners with documents for BRO project 29.
Much of the day was spent reviewing budgets. Reta Rains, treasurer, met with the commission regarding her 2008 budget. Kevin Heldenbrand, sheriff, also met with the commission regarding his budget. All other budgets were tentatively approved and will be finalized on Jan. 28.
Mike Arnold and his client, Lou Nakoneczny, met with Lloyd Riley, Monroe Township, and the commission regarding CART road 159. Mr. Nakoneczny has made repairs to the roadway and asked that the county and township reimburse a portion of the costs. The matter was taken under advisement.
Randy Railsback, Green Hills Regional Planning Commission, met with the commission regarding an emergency planning manual. The county match will be $4,500, half of that amount can be in in-kind services. Having a written plan in place assures the county that FEMA and SEMA will make reimbursements following a disaster. The commission will appropriate those funds in the 2008 budget.

County Clerk
The office will be open Saturday until noon for absentee voting.
Associate Circuit
Jaime L. Odom, Jamesport, was charged Jan. 19 with a felony count of domestic assault second degree, and one misdemeanor count of domestic assault third degree, 1st/2nd offense.
Dale Richardson was charged Jan. 24 with passing bad checks, class C felony.
Mark A. Romesburg, Trenton, was charged Jan. 27 with operating vehicle without valid license, third and subsequent offense, class D felony.
Traffic Fines
The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,341.50 for 21 tickets. The total fines assessed for defendants who reside in Missouri was $798.50 for 17 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Adam G. Coughlin, Harrisonville, was fined $148.50 for speeding and $10 for no seat belt.
Circuit Court
Law Day proceedings were conducted Jan. 22 by Judge Warren McElwain. The following cases were heard:
Stephen W. Sandoval plead guilty to an amended count of possession of controlled substance, class C felony, and two counts of possession of drug paraphernalia, class A misdemeanors, on a plea agreement. The sentence assessment report was waived. Sandoval received four years in the Department of Corrections on the felony charges; court retains jurisdiction and recommends institutional treatment. On the misdemeanors, he received 36 days and 30 days, to be served consecutively in the regional jail with credit for time served.
James V. McBride received a suspended imposition of sentence for possession of controlled substance, class C felony, and five years probation. He was sentenced to three days in the regional jail on a misdemeanor charge of possession of marijuana, with credit for time served.
Erin E. Ward admitted probation violations. Her probation was revoked and she was sentenced to four years in the Department of Corrections for burglary second degree, class C felony.
Kevin W. Peebles plead guilty to operating vehicle without valid license, third and subsequent offense, class D felony; DWI, persistent offender, class D felony. The sentence assessment report was waived by the defendant. Two counts were dismissed. He was sentenced to two years in the Department of Corrections on the first count and three years on the second count, sentences to run consecutively.
The sentence assessment report for John W. Rezek was filed, and he was sentenced to 10 years in the Department of Corrections for DWI, alcohol, chronic offender, class B felony. The court retains jurisdiction and recommends long-term drug treatment.
The sentence assessment report for George W. Delarber was accepted, and he was sentenced to five years in the Department of Corrections for domestic assault second degree, class C felony. He received two years for resisting arrest for a felony, class D felony, and three years for assault on law enforcement, class C felony, sentences to run consecutively. He received three years for possession of marijuana, class A misdemeanor, to run concurrently with other sentences. Execution of sentences was suspended, and he received five years probation with conditions to include 120 days of shock time in the regional jail with credit for time served.
Timothy J. Swanigan plead guilty to stealing, class C felony, based on a plea agreement. The sentence assessment report was waived by the defendant. He was sentenced to three years in the Department of Corrections.
Robbie Hogan admitted probation violations for receiving stolen property. His probation was continued with the additional condition of serving 10 days shock probation.
Charles E. Roberts plead guilty to possession of controlled substance, class C felony and production of a controlled substance, class B felony, based on a plea agreement. One charge was dismissed. A sentence assessment report was ordered.
Melody A. Roberts plead guilty to possession of a controlled substance, class C felony and production of a controlled substance, class B felony, based on a plea agreement. One count was dismissed, and a sentence assessment report was ordered.
A sentence assessment report was ordered for Sandra L. Kriegel, charged with theft/stealing, class C felony, and counterfeiting, class A misdemeanor.
Wesley L. Kriegel plead guilty to the class C felony of stealing by deceit, based on a plea agreement. A sentence assessment report was ordered.
James Dockery Wilson plead guilty to burglary second degree, class C felony, stealing, class A misdemeanor, and property damage second degree, class B misdemeanor. A sentence assessment report was ordered.
On Jan. 28, Judge Brent Elliott set a jury trial for James M. Caldwell, Winston, charged with assault on law enforcement officer, class C felony. The trial will be held on April 10, 2008.
