In a jury trial conducted Oct. 4, Donald W. Newton of Lancaster, S.C., was convicted of child molestation first degree, class B felony, in a change of venue case from Livingston County. The jury began deliberations at 4:09 p.m. and returned to the court at 4:52 p.m. Sentencing was deferred pending a sentence assessment report to be done by the State Board of Probation and Parole. The defendant remains incarcerated on $100,000 cash bond, pending sentencing.

Sheriff’s Office

Daniel Wendt, 32, Polo, was arrested Oct. 5 in Ray County on a Daviess County felony warrant for 35 counts of passing bad checks. He posted $50,000 bond.

Michael L. King, 28, Ludlow, was charged Oct. 8 with two counts of operating vehicle without valid license, class D felony (third and subsequent offense). He posted $5,000 bond.

Christopher Evans, 34, Chillicothe, was charged Oct. 1 with failure to appear on a misdemeanor non-support charge. He is being held on $250 bond.

Darren Ware, 20, Ottumwa, Iowa, was arrested Oct. 7 for misdemeanor possession of marijuana and paraphernalia. He is being held on $750 bond.

Richard Asher, 18, Winston, was arrested Oct. 7 for misdemeanor possession of paraphernalia. He posted $250 bond.

Brandon Archer, 20, Winston, was arrested Oct. 7 on a DeKalb County warrant for misdemeanor minor in possession. He is being held on $1,000 bond.

Brett Olsen, 20, Winston, was charged Oct. 7 with failure to appear on a misdemeanor charge of possession of marijuana. He is being held on $500 bond.

Kevin Baker, 43, Trenton, was arrested Oct. 9 for no valid license and is being held on $5,000 bond.

Noel Martin, 38, Minneapolis, Minn., was arrested Oct. 5 on a Clinton County warrant for misdemeanor passing bad checks. He posted $300 bond.

County Commission

James Lewis, bridge supervisor, reported that they will be installing a metal tube in Jamesport Township this week.

Mary Jo Tillman, Salem Township, requested that the county employees remove brush along her property on 185th Street at the charge of $100 per hour. Also, J. Gary Holcomb, Salem Township, had previously made a request for removal on Beacon Avenue and Axle and 190th Street.

Kevin Heldenbrand, sheriff, Betty Harmison, assessor, and Linda Steward, county clerk, filed their certificates of training for the year.

Dale Dickson, Shafer, Kline and Warren, Kansas City Office, and Lance Rains, Green Hills Regional Planning Commission, met with the commission regarding engineering the electrical lines in the courthouse. Mr. Rains will write a grant application for the county.

A circuit court order was received requiring all commissioned employees of the sheriff’s department to undergo quarterly security training.

The commission met with Kevin Heldenbrand, sheriff, regarding security, storage and budgets.

The commission was notified that Worth Yost, Walter Burnett, and Linda Evans had consented to serve on the Senior Services board.

The commission reviewed the brush control records and plan to check roads next week to confirm that the brush has been eliminated.

Associate Circuit Court

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, courts costs collected for the State of Missouri amount to $66.50 for moving traffic violations and $114.50 in most criminal cases.

Jimmy L. Sias, Chicago, Ill., possession of marijuana, 60 days jail, $25 fine; possession of paraphernalia, 4 days jail, $25 fine.

LaDonna Stroud, Coffey, minor in possession of alcohol, suspended imposition of sentence, two years probation, 30 hours community service, four days shock jail.

Billy W. Herweh, Overland Park, Kan., no valid license, $150; speeding, $88.50.

Johnny A. Jaimes, Ottumwa, Iowa, no valid license, $150; failure to display valid plates, $18.50; no seat belt, $10.

Jessica Henness, Green City, passing bad checks, $25.

Paul C. Westbrook, Prairie City, Iowa, driving while intoxicated, probation review, probation revoked, $350 fine.

Roy L. Bentley, Stanberry, driving while intoxicated, suspended imposition of sentence, two years probation.

Christopher D. Baird, Overland Park, Kan., possession of marijuana, 5 days jail (board bill paid by defendant); failure to drive in right lane, $38.50; no seat belt, $10.

Lester Kurtz, Jamesport, failure to yield to emergency vehicle, $148.50; resisting arrest, 48 hours jail (board bill paid by defendant); failure to display required reflector, $28.50.

Dee Dee Palmer, Independence, no insurance, probation violation, probation revoked, $93.50.

Blair E. Shock, Altamont, failure to yield involving an accident, $28.50.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,142.50 for 18 tickets. The total fines assessed for defendants who reside in Missouri was $993.50 for 18 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Travis L. Peavler, Novelty, was fined $78.50 for operating motor vehicle with no title issued since acquired; $28.50 for failure to display certificate of vehicle inspection; $48.50 for failure to register with DOR.

Civil Court

A breach of contract case by Capital One Bank against Nichole Gutshall was dismissed by the court with prejudice.

Default judgments were entered in two suits on accounts, for Midwestern Health and against Virgil and Kimberly Caldwell; and for Arrow Financial and against Michelle Malone. One suit on account was dismissed by the parties, Midland Funding LLC and Thomas D. Wiegand.
