Daviess County Courthouse News (8-29-07)

James Lewis, bridge supervisor reported that they are continuing repairs.

Bo Harris met with the commission regarding supervising community service workers. She stated that she had not been asked to supervise the workers. Cleaning of the courthouse bathrooms was discussed. She stated that all anyone has to do is call her or leave a note on her door and she will do what is asked of her.

Bills were audited and paid.

Bob Burnett, Snyder and Associates, met with the commission concerning BRO projects in progress. Also, they discussed future bridge replacements, programming bridge 5650020 in Grand River Township for replacement in 2008.

Lance Critten met with a representative from FEMA following up on paperwork from the May floods.

Kevin Heldenbrand, sheriff, met with the commission regarding vehicle repairs that are needed.

Kent Tonnies, APAC Quarry, met with the commission regarding the rip rap bids and delivery.

The commission inspected the storage areas at the industrial building following completion. Keys will be made and given to officeholders for additional storage for their records.

Sheriff’s Office

Jody John Olsen, 28, Lyons, Neb., was arrested Aug. 27 by the Dakota County Sheriff’s Department in Nebraska, on three Daviess County counts of felony non-support. He is awaiting extradition to Daviess County. Bond is set at $15,000.

James V. McBride, 29, Texas City, Texas, was arrested Aug. 27 in a traffic stop, charged with possession of controlled substance, class C felony, possession of controlled substance and possession of paraphernalia, both class A misdemeanors. Bond was set at $35,000 cash.

Eleanor L. Tatro, 35, Kearney, was charged Aug. 23 with possession of marijuana and paraphernalia, both misdemeanors. She is being held on $750 bond.

Bart Pliley, 23, Jamesport, was arrested Aug. 21 for misdemeanor assault third degree. He posted $250 bond.

Joshua Wiggins, Cedar Rapids, Iowa, was arrested Aug. 26 for misdemeanor no valid license. He posted $400 bond.

Elisha D. Cranmer, 29, Olathe, Kan., was arrested Aug. 27 for felony non-support. He is being held on $10,000 bond.

Wayne Clabaugh, 29, Parnell, was charged Aug. 27 with felony passing bad checks. He is being held on $7,500 bond.

Associate Circuit Court

Defendants found guilty in the Associate Division of the Circuit Court of Daviess County are listed below with the offense and fine assessed. Additionally, court costs collected for the State of Missouri amount to $66.50 for moving traffic violations and $114.50 in most criminal cases.

Victor Hamilton, Kansas City, driving while revoked, 80 days jail; speeding, 5 days jail; failure to yield to emergency vehicle, 5 days jail.

Samuel Storer, Trenton, driving while intoxicated, 48 hours jail; resisting arrest, 15 days jail; assault, 15 days jail; careless and imprudent driving, leaving scene of vehicle accident, speeding, failure to stop at stop sign, 48 hours jail on each count; no seat belt, $10.

Sammy N. Daudinot, Kansas City, speeding 106 mph in 70 mph zone, 48 hours jail, $250 fine.

Arianne B. Rosenstangle, Jamesport, no valid license, 10 days jail; no insurance, $103.50.

Tyler S. Allen, Trenton, probation violation on speeding charge, probation revoked, $88.50 fine.

Marcus T. Jordan, Joliet, Ill., no valid license, $150.

Andrew Egbert, Winston, no rear license lamp, $18.50; no seat belt, $10.

Jeffrey S. Shanks, Winston, probation violation on possession of marijuana, probation revoked, 48 hours jail, credit for time served; probation violation on possession of paraphernalia, $150 fine.

Ronald D. Kennedy, Cameron, careless and imprudent driving involving an accident, guilty by trial, five days jail, suspended execution of sentence, two years probation.

Cathy Focht, Topeka, Kan., three counts of passing bad checks, $25 each count.

Emerson Lightfoot, Kansas City, Kan., no valid license, $150; possession of marijuana, 48 hours jail (board bill paid by defendant); possession of paraphernalia, $150; speeding, $58.50.

Joseph J. Storto, Ottumwa, Iowa, possession of marijuana, four days jail (board bill paid by defendant); possession of paraphernalia, $150.

Brian J. DeWeese, Gallatin, was sentenced to two days jail for possession of marijuana and fined $150 for possession of paraphernalia.

Triesa M. Parker, Gallatin, was fined $7.50 for no muffler; $27.50 for failure to stop at stop sign.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $939 for 15 tickets. The total fines assessed for defendants who reside in Missouri was $576.50 for 13 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

No seat belt ($10 fine): Christopher J. Rinehart, Turney; Megan M. McQuinn, Turney; Rose M. Eubanks, Richmond; Caleb P. Phillips, Albany.

Failure to stop at stop sign: Melinda G. Untiedt, Springfield, $28.50.

Speeding amended by prosecuting attorney to defective brakes ($143.50 fine): Jennifer L. Pullen, Cameron; Steven A. Barker, Clinton.

Failure to display valid plates ($18.50 fine): Raymond L. Loucks, Gallatin; Zachary D. Gutzmer, Gallatin.

Speeding ($58.50 fine): Randall D. Booth, Pattonsburg; Todd A. Stewart, St. Joseph.

Failure to drive on right half or road: Brandon E. Hersh, Lee’s Summit, $38.50.

Ronald R. Davis, Jr., Kansas City, was fined $28.50 for vision reducing material and no seat belt.

Civil Court

A consent judgment was entered for GA Financial and against Rick Hendricks for a suit on account.

A revival of judgment was ordered for Ford Motor Credit Company, against Kenneth E. Archer.

Circuit Court

In Law Day proceedings conducted Aug. 21 by Judge Warren McElwain, the following cases were heard:

Kevin L. Parker plead guilty to resisting arrest, class D felony, and attempted assault of law enforcement officer, class A misdemeanor, based on a plea agreement. The defendant waived the sentence assessment report. He was sentenced to two years in the Department of Corrections on the first count and 60 days in the regional jail on the second count, with credit for time served.

Brian King was sentenced to five years in the Department of Corrections for passing bad checks, class C felony. Execution of sentence was suspended, and he received five years supervised probation.

Carl E. McCartney admitted violations of seven conditions of his probation for non-support, class C felony. His probation was revoked, and he was sentenced to four years in the Department of Corrections, execution of sentence suspended. He received five years supervised probation.

Betsy Young-Jo Bonin had previously plead guilty to felony possession of controlled substance and two counts of misdemeanor drug paraphernalia. She was sentenced to seven years in the Department of Corrections on the felony charge. On the misdemeanors, she received 30 days in the regional jail on each count, to be served consecutively, with credit for time served. The court retained jurisdiction and recommends institutional treatment.

Brian J. Mahan admitted violations of 10 conditions of his probation for two class C felony counts of possession of controlled substance. Probation was revoked, and he was sentenced to five years in the Department of Corrections, execution of sentence suspended. He received four years supervised probation.

Michael L. Love admitted violations of two conditions of his probation for robbery second degree, class B felony. His probation was continued with the additional condition that the defendant successfully complete in-patient drug treatment and serve 30 days shock probation, with credit for time served. There will be no more chances given.

Bryon Dickerson admitted violations of three conditions of his probation for burglary second degree, class C felony, and domestic assault third degree, class A misdemeanor. Probation was continued with the additional condition of serving 30 days shock probation in the regional jail, with credit for time served. Defendant to be under intensive supervision by Missouri Probation and Parole.

Laura Yvette Flores plead not guilty to possession of controlled substance, class C felony, and operating motor vehicle without valid license, class A misdemeanor. A sentence assessment report was ordered.

Dustin R. Esterline plead guilty to operating motor vehicle without license, class D felony, and DWI, class A misdemeanor. A sentence assessment report was ordered. Counts 3 and 4 were dismissed by the state.

Roy R. Robinson plead guilty to stealing, class C felony. A sentence assessment report was ordered.

Paula J. Purcell plead guilty to four charges of possession of controlled substance, class A misdemeanor, one count of drug paraphernalia, class A misdemeanor, one count possession of controlled substance, class C felony, and distribution of less than 5 grams marijuana, class C felony. A sentence assessment report was ordered.

Motions for a change of judge were filed by James M. Caldwell and Bo D. Eaton. Caldwell is charged with assault on a law enforcement officer, class C felony. Eaton is charged with DWI-persistent offender, class D felony, possession of marijuana, class A misdemeanor, drug paraphernalia, class A misdemeanor, and speeding, class A misdemeanor. Both cases were transferred to Judge Stephen K. Griffin.

A jury trial was set for Nov. 2, 2007, for Robert D. Canaday, charged with non-support, class D felony.

A jury trial was set for Jan. 4, 2008, for Tyrone D. Ellis, charged with possession of controlled substance, class C felony.

Warrants were issued for Charles Corder and Gilbert Parker Jr. Corder is charged with assault – 2nd degree, class C felony. Parker is charged with resisting/interfering with arrest for a felony, class D felony.

Judge Jason Kanoy, Caldwell County Associate Circuit Court, presided Aug. 27 over a scheduled docket of non-support cases. Paul M. Esposito plead guilty to two counts of felony non-support and on each count was placed on four years supervised probation. Elisha D. Cranmer appeared and a continuance was granted. An outstanding warrant was served on Cranmer for a previous probation violation, and she was incarcerated in the regional jail on $10,000 cash bond, pending her next court date. 

In a case on a promissory note, heard Aug. 15 by Judge Warren McElwain, judgment was entered for MFA Incorporated and against John Craig First and Lacey J. First for the sum of $55,918.29.
