James Lewis, bridge supervisor, met with the commission reporting that they are continuing to make repairs following the flooding in May.

Deanna Lewis, Gallatin Multi-Purpose Center, met with the commission reporting on the progress of the grant recently awarded them for expansion of services to seniors.

The commission audited and paid bills. They also discussed flood damage estimates and applications with the State Emergency Management Agency.

Wayne Shaw met with the commission to deliver his key to the Lambert Building.

Darryl Wilkinson met with the commission regarding leasing a portion of the building located at 609 South Main. A verbal agreement was made with a formal agreement to be made July 1.

At 11 a.m. as advertised, bids were opened for stripping and cleaning of the floor in the Recorder’s Office. Only one bid was submitted. It was unanimously decided to accept the bid of Blanch Archer. No bids were received for construction of a concrete block storage area at 609 South Main.

At 2 p.m. as advertised, bids were opened for an audit of the county’s finances for the years of 2005 and 2006. Two bids were received. Danny Heldenbrand moved to accept the bid from Daniel Jones & Associates at $15,000, seconded by David Holcomb. The motion was approved by Heldenbrand and Holcomb. Critten was absent.

These are the approved minutes of June 25, 2007. All commissioners were present.

Associate Circuit Court

Ashley Houser, Gilman City, was charged June 28 with passing bad checks, class C felony.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,014.50 for 17 tickets. The total fines assessed for defendants who reside in Missouri was $797 for 14 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Municipal Division

Court costs for moving violations $32.50; non-moving $29.50.

LaToya N. Martin, Gallatin, was sentenced to five days jail for driving while suspended and fined $50 for making a prohibited U-turn.

Coltin D. Loucks, Gallatin, received a suspended imposition of sentence two years probation, and eight hours community service for assault.

Joy Landis, Cameron, was fined $100 for driving with plates of another vehicle and $200 for driving while suspended amended by prosecuting attorney to defective equipment.

Civil Court

Two breach of contract suits were dismissed: Capital One Bank vs. Vickie S. Hoig, dismissed by parties; Harrison County Hospital vs. Walter Stagner, dismissed by court without prejudice.

Default judgments on four suits on accounts were entered for the plaintiffs as follows: for Elite Recovery and against Chester Dunlap; for Midwestern Health and against Melvin and Ann Nitzaschke; for Midwestern Health and against Katherine L. Cranmer; for Midwestern Health and against Randy and Jennifer R. Hisel. One suit on account was dismissed by the parties: Midwestern Health vs. Jerome L. Houghton.

Small Claims

Two suits were dismissed by the parties: City of Gallatin vs. Leo and Sherry Hogan; City of Gallatin vs. Glennie Perry.

Craig Nelson Gottswiller and Sherry Elaine Peter were married by Daren L. Adkins on June 28, 2007.

Circuit Court

Dissolutions of marriage were granted June 26 by Judge Warren L. McElwain to Cher A. Gadd from Thomas Timothy Gadd and to Nina Lee Funke from Loren Douglas Funke.

On June 26, a default judgment was entered for the plaintiff, Vanderbilt Mortgage and Finance, and against Terry L. Short Jr., and Rebecca L. Short for damages totaling $33,938.26 and possession of a 1997 Liberty mobile home.

The following cases were heard on Law Day, June 19, by Judge Warren McElwain:

A jury trial for Eric A. Mims, Kansas City, was set for Aug. 17, 2007, on a charge of class D felony possession of controlled substance.

A jury trial for Tyrone D. Ellis, Little Rock, Ark, was set for Aug. 22, 2007, on a charge of possession of controlled substance, class C felony.

A jury trial for Mark A. Kortz, Pattonsburg, was set for July 10, 2007, on a charge of theft/stealing, class C felony.

Criminal cases filed: State of Missouri vs. Charles A. Barlow, Excelsior Springs, three counts of non-support, class D felony.

Civil cases filed: Casey John Gienapp vs. Trina Marie, Gienapp, both of Altamont, dissolution of marriage.

Sheriff’s Department

David R. Alliet, 47, Altamont, was arrested July 1 for the class C felony of DWI, alcohol, aggravated offender. He is being held on $35,000 bond.

Jessica Holt, 25, Trenton, was charged June 30 with passing bad checks, class A misdemeanor. She is being held on $600 bond.
