County Commission

James Lewis, bridge supervisor, reported that they continue to make repairs on two bridges and four culverts damaged by flood waters as soon as conditions permit. He also filed completed work orders documenting their work.

Sharon Hon, Sheridan Township, met with the commission reporting drainage problems. She was referred to the USDA office for guidance.

Bills were audited and paid.

The commission discussed brush control in the county. Some certified letters were returned and another method of notification will be used prior to removing the brush.

Kevin Heldenbrand, sheriff, met with the commission reporting on the medical condition of some prisoners.

The commission contacted the township boards requesting costs involved following the heavy rains and flooding earlier in the month. SEMA will collect all the information May 24.

Notification was received from the State Tax Commission that the Consumer Price Index for this fiscal year has been determined to be 2.6%.

Notification was received from the Missouri Department of Economic Development that the HUD/CDBG Environmental Review Process is complete for the PWSD #4 project.

Due to the Memorial Day holiday, the next commission meeting will be Tuesday, May 29.

Sheriff’s Department

Bryan Stark, 37, Jamesport, was charged May 27 with leaving the scene of an accident, class D felony. He posted $15,000 bond.

Orville D. Curtis, 50, and Michael Mooney, 28, both of Jamesport, were arrested May 27 and each was charged with the class A misdemeanor of domestic assault. Each posted $250 bond.

James Bolin, 40, Trenton was arrested May 28 in Grundy County on a Daviess County warrant for passing bad checks, class A misdemeanor. He posted $150 bond.

Jesse O. Harvey, 29, Fisk, was charged May 25 with failure to appear on a charge of careless and imprudent driving resulting in accident, class A misdemeanor. Bond was set at $500.

Roberto Gonzalez Garcia, 35, Kansas City, was arrested May 25 for misdemeanor DWI and resisting arrest. He is being held on $1,000 bond.

Raymond Morris, 31, Cameron was charged May 27 with failure to appear on a probation violation, on an original felony charge of no valid license, class D felony. Bond is set at $25,000.

Phillip Moorehead, 32, Kansas City, was charged May 29 with failure to appear on a probation violation, on an original charge of possession of controlled substance with intent to deliver, class B felony. Bond was set at $25,000.

Circuit Court

Law Day was conducted on May 22, 2007, with Judge Warren McElwain presiding. The following cases were heard:

Terrance L. Daughtery had plead guilty April 26 to an amended charge of class C felony possession of controlled substance, based on a plea agreement. The sentence assessment report was accepted as amended. Defendant was sentenced to five years in the department of corrections. The court retains jurisdiction under Section 559.115 and recommends institutional treatment.

John J. Moreno admitted a probation violation. His probation was continued with an additional condition of 20 hours community service.

Dennis A. Swearingin plead guilty to operating a vehicle without a valid license, class D felony, based on a plea agreement. The sentence assessment report was waived, imposition of sentence suspended, and defendant placed on five years probation, with one probation condition being to serve 30 days shock time.

Tiffany L. Ellis was released from jail to attend drug treatment. A jury trial is set for Aug. 22 on the charge of possession of controlled substance, class C felony.

Mark A. Kortz plead not guilty to stealing, class C felony. He was committed to the Daviess-DeKalb Regional Jail in lieu of bail. A jury trial is set for July 10, 2007.

Eric A. Mims plead not guilty to possession of a controlled substance, class D felony. A request for bond reduction was denied. He was committed to the Daviess-DaKalb Regional Jail in lieu of bail.

A warrant was issued for the arrest of Phillip E. Moorhead, who failed to appear for a probation violation hearing for possession of controlled substance with intent to distribute, class B felony. Bond was set at $25,000 cash only.

A warrant was issued for the arrest of Raymond F. Morris, who failed to appear for a parole violation hearing for operating motor vehicle without valid license, class D felony. Bond was set at $25,000 cash only.

Garth A. Restad entered a plea of not guilty to possession of a controlled substance, class C felony.

Marcia K. Evans was sentenced to 10 years in the Department of Corrections, execution of sentence suspended, and received five years probation for the class B felony, possession of controlled substance with intent to distribute. Special conditions of probation include completion of the Missouri post conviction drug treatment program and serving 35 days shock time.

A motion for a change of judge was granted to Orville E. Newberry III. The case was transferred to Judge Stephen K. Griffin. Newberry is charged with sexual assault, class C felony.

Michael Bibby was sentenced to five years in the Department of Corrections for possession of controlled substance, class C felony. The court retains jurisdiction under Section 559.115 and recommends institutional treatment.

Criminal cases filed: State vs. Steven H. Prindle, Jameson, domestic assault second degree, class C felony.

Civil cases filed: Shannon Kathleen Miller vs. Michael Lynn Miller, both of Gallatin, dissolution; In re Matter of William Earnest Brown Jr., Cameron, change of name.

Associate Circuit

Warrants were issued May 21 for Julia Ann Carter and Robert E. Carter, both of Altamont. They are each charged with possession of controlled substance, class C felony, possession of marijuana, class A misdemeanor, unlawful use of drug paraphernalia, class D felony, and keeping or maintaining a public nuisance, class C felony. Bond is set at $35,000 for each.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,718 for 27 tickets. The total fines assessed for defendants who reside in Missouri was $1,738.50 for 31 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Kevin R. McCleary, Altamont, was fined $18.50 for no valid plates and $10 for no seat belt.

Katie R. Long, Lawrence, Angela M. Helm, Kansas City, and Angela R. Mayzsak, Excelsior Springs, were each fined $88.50 for speeding and $10 for no seat belt.

Kerrie L. Kennedy, Winston, was fined $28.50 for no turn signal and $10 for no seat belt.

Walter D. Waldron, Liberty, was fined $28.50 for window tint not in compliance and $18.50 for failure to affix front plate.

Civil Court

Default judgments for suit on account were entered for the plaintiffs: for Worldwide Asset Purchasing LLC and against Dana M. Cameron; for Midland Funding LLC and against Carol Hailey.

A consent judgment for suit on account was entered for Midland Funding and against Pamela S. Sifers.
