This letter is in response to the article in the Jan. 17, 2007, St. Joseph newspaper regarding the murder plea in Daviess County and the former Prosecutor’s comments to the victim’s family on my competence to handle the matter.
First of all, I want to thank everyone for your words of encouragement. I greatly appreciate all of your support. For those who ask why I could not be reached for response, the day I was contacted was criminal law day, and I was in the courtroom into the afternoon. I did return the reporter’s call, but he did not respond.
Regarding the plea negotiations and comments made to the family of the victim, I am limited in my response by various statutes and rules of professional conduct. While a case is pending, and even after it is concluded, I have a responsibility to refrain from making comment about certain aspects of the prosecution. In addition, I was not present at any meetings between Ms. Filley and the defense attorneys. I was made aware of the agreement only when the victim’s family came to my office to show me the letter sent to them by Ms. Filley.
The voters of Daviess County made it clear last summer who they believe to be the best and most competent candidate for this office. I can assure you that I am committed to this office, and that I am working very hard to be the kind of prosecuting attorney this great county deserves.
