Lance Critten reported that the sewers were inspected last week. No major problems were found in the system. The restrooms will be remodeled this year, installing commercial grade facilities.

James Lewis, bridge supervisor, reported that three tubes were installed last week. Due to the cold weather, they will work at the barn making repairs this week. He has received notice that the excavator will be delivered this week.

David Holcomb and Lance Critten attended the Department of Natural Resources meeting in Bethany on Jan. 11, 2007.

Reta Rains, treasurer, met with the commission questioning funds needed for expenses early in the year, prior to making investments.

The commission reviewed budget requests.

Marvin Landes met with the commission regarding road problems in Grand River Township.

Kevin Heldenbrand, sheriff, and Ben Becerra, chief deputy, met with the commission regarding the 2007 budget.

Betty Harmison, assessor, met with the commission regarding her budget for 2007.

Associate Circuit

Chad Russell Wormsley, Polo, was charged Jan. 16 with possession of a controlled substance, class C felony.

Traffic Fines

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,650.50 for 24 tickets. The total fines assessed for defendants who reside in Missouri was $1,369.50 for 22 cases. Court costs collected for the State of Missouri amount to $56.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Failure to display valid plates: Cole K. Froman, Gallatin, $18.50.

No seat belt: Tammy S. Pipes, Laredo, $10; Sandy B. Spruell, Kansas City, $10; Terry W. Cameron, Harrisonville, $10; John C. Moots, Trenton, $10.

Speeding: Darren R. Gallop, Madison, $28.50; Teresa W. Boyd, Gallatin, $28.50; Maria T. Lewis, Kansas City, $28.50; Vincent A. Wandix, St. Louis, $28.50; Valerie A. Hutton, Cameron, $28.50; Moriah Buis-Talada, Gallatin, $118.50; Steven B. Williamson, Kansas City, $88.50.

Malorie D. Love, Gallatin was fined $28.50 for speeding and $10 for no seat belt.

Civil Court

Midwestern Health Management vs. Donnie D. Cecil: judgment entered for the plaintiff Midwestern for $787.63, plus costs and interest.

Sheriff’s Office

Ronald L. Tarepin, 20, Winston, was charged Jan. 19 with two felony counts of delivery of a controlled substance to a correctional facility. Bond was set at $50,000.

Roger L. Burton, 36, Malta Bend, was arrested Jan. 22 on probation violations for felony non-support. He is being held on $10,000 bond.

Robert Sharp, 26, Trenton, was arrested Jan. 20 for failure to appear on misdemeanor charges of passing bad checks. He posted $200 bond.

Mathew Davis, 24, Princeton, Minn., was charged Jan. 21 with failure to appear on a class C felony charge of possession of controlled substance and class A misdemeanor drug paraphernalia. Bond was set at $70,500.

Charles Corder, 22, Independence, was arrested Jan. 18 for probation violation on an original felony charge of assault second degree. Bond was set at $25,000.

Circuit Court

In Law Day proceeding conducted Jan. 16, 2007, the following cases were heard by Judge Warren McElwain:

In State vs. Phillip K. Sharp, charged with endangering the welfare of a child, class C felony, and assault third degree, class A misdemeanor, the motion for change of judge was granted, and the case transferred to Judge Stephen Griffin.

Garfield M. Collier, charged with possession of controlled substance with intent to distribute, class B felony, and drug paraphernalia, class A misdemeanor, the motion for a new judge was granted, and Judge Stephen K. Griffin was assigned to the case.

Erin E. Ward entered a guilty plea to the charges of burglary 2nd degree, class C felony, and stealing, class A misdemeanor, based on a plea agreement. The court ordered a sentence assessment report.

Joseph Fosdick plead not guilty to charges of possession of controlled substance, class C felony, and possession with intent to deliver, class B felony. The case was continued.

Robert Danner, charged with forgery, assault third degree and forcible rape, was granted a change of judge. The case was transferred to Judge Stephen K. Griffin.

A warrant was issued for the arrest of Bryan C. Thomas, who failed to appear for a hearing on the charge of operating a vehicle without valid license, third and subsequent offense, class D felony.

Probation was revoked for Allen L. Konopasek Jr. on two charges of felony non-support. The previously imposed sentence of four years in the Department of Corrections was ordered executed.

A warrant was issued for Roger L. Burton for failure to appear for a scheduled probation violation hearing on felony non-support charges. Bond was set at $10,000 cash.

Jury trials were set for Donald W. Newton on March 6, charged with statutory sodomy first degree, in a change of venue case from Livingston County; Roger W. Roedel on March 30, charged with property damage first degree, class D felony; and for James L. Gasaway on April 11, charged with unlawful use of a weapon, class D felony, and resisting arrest, class D felony.

Cassandra L. Ward plead guilty to burglary second degree, class C felony, and received a 5-year sentence, imposition of sentence suspended, five years probation on a class A misdemeanor charge of theft/stealing, she was sentenced to 150 days in the county jail, beginning Jan. 16.

Michael D. Brown appeared for a probation violation hearing on a class C felony charge of possession of controlled substance. Probation was continued on the additional condition that the defendant serve 60 days shock time at the Daviess-DeKalb Regional Jail, credit given for time served.

Civil cases filed: Bobbie Anderson of Gallatin vs. Ronald Samuel Anderson, Princeton, dissolution of marriage.

Recorder’s Office
