County Commission
Don Ohlberg, bridge foreman, met with the commission reporting that metal culverts were placed in Jefferson Township last week and they will be pouring concrete decks this week.
Notice was received from Missouri Department of Transportation for the approval of awarding the construction contract on bridge 60600091, BRO (28), to Harry H. Houf and Sons Contractors at $382,873.10.
Bills were audited and paid.
Bob Burnett, Snyder and Associates, met with the commission for the 10 a.m. opening of bids for BRO 27, as advertised. Bids were received from Houf, Wiedel, Irvinbilt, Bestgen. The engineer’s estimate was $406,595.60. Houf’s was the apparent low bid at $374,410.70. Mr. Burnett will review the bids for accuracy and compliance.
The commission discussed brush control. Several certified letters have been returned. The commission discussed publishing or posting notices in the townships. No action was taken at this time.
David Tolen contacted Robert Cowherd regarding pending legal matters.
These are the approved minutes of Oct. 30, 2006. All commissioners were present, as well as David Michael, candidate for presiding commissioner. Minutes were approved as presented.
Sheriff’s Department
Brian Krumbiegel, 24, and Johnathan Warren, 23, both of Overland Park, Kan., and Joseph Fasdick, 22, of Cedar Rapids, Iowa, were each charged Nov. 3 with the class B felony of possession of a controlled substance with intent to deliver and the class C felony possession of a controlled substance. Krumbiegel posted $85,000 bond. Fasdick and Warren are being held on $85,000 bond.
Daniel Phelps, 43, Chillicothe was arrested Nov. 1 on 8 counts of passing bad checks, class C felony. He is being held on $15,000 bond.
Justin Baker, 21, Gallatin, was arrested Nov. 1 for possession of loaded firearm while intoxicated, class D felony, and four misdemeanor charges, DWI, resisting arrest, careless and imprudent, and littering. He posted $5,000 bond.
Ronald Mayfield, 35, Matthew Davis, 24, and Garth Restad, 33, all of Princeton, Minn., was arrested Nov. 2 and each was charged with possession of methamphetamine, class C felony, and possession of paraphernalia, class A misdemeanor. Mayfield posted $35,000 bond. Davis and Restad are being held on $35,000 bond.
Jesse A. Brown, 20, and Lauren Holcomb, 17, both of Gallatin, were each charged Nov. 3 with minor in possession. They were processed and released.
Renee Bales, 28, Des Moines, Iowa, was charged Nov. 2 with misdemeanor driving while revoked. She posted $500 bond.

The following are traffic cases which were heard in the Associate Division of the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,190.50 for 13 tickets. The total fines assessed for defendants who reside in Missouri was $733 for 16 cases. Chick’s Inc d/b/a/ My Store vs. James Michael Webber d/b/a Able Electric: The plaintiff Chick’s voluntarily dismissed the case with prejudice, based upon the defendant’s satisfaction of the account.
North Star Capital Acquisitions vs. Douglas E. Rollen: Consent judgment was entered in favor of the plaintiff North Star for a total of $4,288.24 plus costs and interest; stay of execution granted based upon payment agreement.
Circuit Court
Law Day proceeding were held Nov. 7, officiated by Judge Stephen K. Griffin.
Bond was reduced from $250,000 to $100,000 for Elbert L. Fry, Gallatin, charged with two counts of child molestation first degree, class B felony. Cash bond was posted with conditions imposed. Trial setting will be on Jan. 16, 2007.
Leroy G. Wallace, Gallatin, plead guilty to two amended counts of endangering the welfare of a child first degree, class C felony. On a plea agreement, the defendant waived his right to a sentence assessment report and sentencing hearing. He was sentenced to seven years in the Department of Correction on each count, sentences to run concurrently, execution of sentence suspended. He received five years probation under supervision of Missouri Probation and Parole.
Carsley L. Crabree, Pattonsburg, received a suspended imposition of sentence and five years probation under supervision of Missouri Probation and Parole for three felony counts of arson and one of attempted arson. He was also sentenced to the Missouri Post Conviction Drug Program under 217.785 RSMo.
