by Daren Adkins, Daviess County Associate Circuit Judge

Daviess is the first county in the 43rd Circuit to have its cases available to the public on the internet through Case.net. Daviess County went online last Friday. This is made possible through the efforts of of the Circuit Clerk Linda Adkins, deputy clerk, Pam Howard, and the Associate Division clerks, Sue Bird, Sandy Dustman, and Karen Johnson.

The entire 43rd Circuit implemented a new software program known as JIS on Jan. 23. The Justice Informatin System (JIS), while difficult and time consuming for the judges and clerks to learn and use, does have one important benefit – Case.net. Case.net is an online site that allows public access to Missouri judicial records on any computer connected to the internet from 6 a.m. to 1 a.m. Monday through Friday. There is no charge and no user name or password needed to use this site. Case.net provides anonymous, public access to litigant information, judges, attorney names, filing dates, cases filed, docket entries, scheduled court dates, dispositions such as civil judgments, criminal convictions and sentences, and any other information normally found in our paper files – which are still maintained as the permanent record.

Access to the online system may be found on the Missouri courts website at www.courts.mo.gov and click on the “Case.net” link in blue. Once in Case.net, you may choose to search by the litigant’s name, date of filing, case number, or by the court date. After choosing one of these search methods, you may then search the entire system or scroll through to a specific court, circuit or county. Daviess, Caldwell, DeKalb, Livingston, and Clinton are the counties in the 43rd Circuit.

While new and old cases are added daily, generally all cases filed after Dec. 1, 2005, are accessible. Civil judgments and probate cases completed and closed before Jan. 23, 2006, are not generally available on Case.net. Cases that are “sealed” by Missouri statute, such as juvenile records and dismissed criminal cases are not open to the public.

If you cannot find what you are looking for on Case.net, or do not understand what you found, I encourage you to call the Daviess County Circuit Court at 660-663-2532; write to the court at P.O. Box 233, Gallatin, MO 64640; or come to the office located on the second floor, room 6, of the Daviess County Courthouse, for help. If you do not have a computer and wish to search online, there is a public access terminal located in the Circuit Clerk’s office on the third floor.
