On March 8, the City of Gallatin filed a motion for a temporary restraining order against Gene Schweizer of Gallatin. A hearing on the motion is set for April 4. The City of Gallatin is represented by Andereck, Evans, Milne, Peace and Widger LLC of Trenton.

The city is petitioning for a permanent injunction against the defendant, Victor Gene Schweizer. In the petition, the city states that Schweizer has entered city hall on "as many as 100 occasions to question city employees and to request voluminous documents relating to the operations of the city."

The petition goes on to say that Schweizer became verbally abusive to city employees on several occasions. The petition claims that the actions of Schweizer "constitute a threat of immediate and irreparable injury, loss and damage to the City of Gallatin and such actions constitute an impediment to the continued function of city government …"

In sworn affidavits by city employees, it is stated that "the actions of the defendant (Schweizer) constitute a threat to the ability of city employees to provide the expected and required city service to the citizens of Gallatin …"

In its petition, the city is asking that Schweizer be "perpetually restrained and enjoined from entering upon the premises of the city hall."
