TAKE NOTICE THAT ON FRIDAY, MARCH 10, 2006, AT 2:00 P.M., AT THE SOUTH DOOR OF THE DAVIESS COUNTY COURTHOUSE, IN GALLATIN, MISSOURI, ON THE ORDER OF THE CIRCUIT JUDGE OF DAVIESS COUNTY, MISSOURI, THE SHERIFF OF DAVIESS COUNTY, MISSOURI WILL SELL AT PUBLIC VENDUE TO THE HIGHEST BIDDER, THE REAL PROPERTY DESCRIBED AS FOLLOWS;
All of the East Half of the Southeast Quarter of Section Seven; the East Half of the West Half of the Southeast Quarter of Section Seven; and all that part of the Northeast Quarter of Section Seven that lies South and East of Missouri State Highway No. 6, in Township Fifty-nine North of Range Twenty-six West of the Fifth Principal Meridian, containing 212 acres, more or less; EXCEPT that part conveyed for highway purposes, including 2.21 acres conveyed by deed dated January 6, 2003, and recorded in Book 304 at Page 294 in the Daviess County Recorder’s Office.
The terms of the sale are as follows:
1) The sale will be at public auction conducted by the Sheriff of Daviess County, Missouri, to be held at the South front door of the Daviess County Courthouse in Gallatin, Missouri;
2) The successful bidder will be required to sign a contract for purchase of the real estate which will include these terms: the sale is to be for cash, with a down payment equal to 10% of the successful bid to be paid on the date of the sale, which down payment will be forfeited if the bidder fails to close the sale except for defects in the title, and the balance of the bid price to be payable at the closing of the sale, which shall take place within 30 days of the date of the auction;
3) The successful bidder will be provided a title insurance commitment in the amount of the bid, showing marketable title in fact for the property to be in the parties hereto, with all liens and encumbrances to be satisfied at the closing;
4) Possession will be given at the closing;
5) Real estate taxes on the property for year 2005 and prior years will be paid from the sale proceeds;
6) The sale includes all buildings, fences, and other improvements on the property; and
7) The Property is to be sold subject to all easements, covenants, and restrictions now of record.
