TRUSTEE’S SALE – For default in the payment of debt and performance of obligation described in and secured by Deed of Trust executed by Raymond E Benedict Sr and Heather A Benedict, his wife dated 11/06/2002, and recorded on 11/13/2002 in Book 196, page 37 in the office of the Recorder of Deed for Daviess County, MISSOURI, the undersigned Successor Trustee, at the request of the legal holder of the debt, who has elected to declare the entire debt due and payable, will on Wednesday, 01/25/2006 between the hours of 9:00 a.m. and 5:00 p.m. (2:00 p.m.) at the South Front Door of the Daviess County Courthouse, 102 N Main St. Gallatin MO 64640 in the City of GALLATIN, State of Missouri sell at public venue to the highest bidder for cash, the realty described in said deed of trust, to wit:
All that part of the Southeast Quarter of the Northwest Quarter of Section Three (3), Township Fifty-eight (58), Range Twenty-nine (29), lying South of the right-of-way of the C.R.I & P. Railroad, described as follows: Commencing at the Southwest corner thereof, and running thence East to a point 545 ½ feet West of the East line of said Southeast Quarter of the Northwest Quarter, thence North to the South line of the C.R.I. & P. Railroad right-of-way, thence Westerly along the South line of said right-of-way line of said Southeast Quarter, Northwest Quarter, thence South to the place of beginning. Subject to right-of-way for state highway and public roads, and EXCEPT the Two (2) following described tracts: (1) Beginning at the point where the East line of the above described tract intersects the South line of the right-of-way of the present surveyed state highway as the same is now located and constructed, thence in a westerly direction following the South line of said state highway, a distance of 250 feet, thence in a Southerly direction at right angles with said state highway, a distance of 77 feet, thence in an Easterly direction parallel with said state highway to a point 77 feet from the South line of said state highway, directly South of the point of beginning, and thence North to the point of beginning; AND (2) Commencing at a point on the West line of said Southeast Quarter of the Northwest Quarter where said line intersects the South line of the right-of-way of the present surveyed state highway as the same is now located and constructed, thence South 116 feet, thence Easterly and parallel with the South line of said state highway, a distance of 150 feet from the East line of the public road as now laid out on the West side of said Southeast Quarter of the Northwest Quarter, thence North 116 feet to the South line of the right-of-way of said state highway, and thence Westerly and following the South line of said state highway to the point of beginning..
Subject to easements, restrictions, reservations, and covenants, if any, to satisfy said debt and cost.
