TO: Defendant Harry L. Pitts and the heirs, devisees, successors and assigns of Charlene Kirk, Virgil Pitts, Kathleen Pitts, deceased, and to David Gauldin, Elizabeth Irene Kirk Gauldin, John Bradshaw, Linda G. Kirk Bradshaw and Robbie Lampkin and all other persons and entities, known and unknown, claiming any right , title, estate, lien, or interest in the real property described in this Petition to Quiet Title to Real Estate and to Reform Deed of Trust, adverse to plaintiff’s Deed of Trust interest.
1. You are hereby notified that an action to Quiet Title has been commenced against you in the Circuit Court of Daviess County, Missouri, the object and general nature of which is to establish rights for the following described real property in the name of Altegra Credit Corporation, to wit:
“Commonly known as 13218 162nd Street, Pattonsburg, Missouri 64670, sitting on one acre more or less. The East Half of the Northwest Quarter of Section Eighteen (18), Township Sixty-one (61), of Range Twenty-eight (28), Salem Township, Daviess County, Missouri, containing 80 acres more or less according to the government survey.”
2. The names of all the parties in the captioned action are listed in the Petition filed with the court.
3. The name and address of the attorneys representing the plaintiff are: Richard L. Martin and Matthew R. Grundy, Suite 400, 1044 Main Street, Kansas City, Missouri 64105.
4. You are further notified that unless you file an answer or other pleading or otherwise appear and defend against this action within 45 days after the date of first publication of this Notice, judgment by default will be taken against you.
5. The date of the first publication is the 27th day of October, 2004.
