Criminal Law day was conducted Jan. 8 by Judge Stephen K. Griffin. The following cases were heard:
In State of Missouri vs. David R. Winfree Jr., the defendant entered a guilty plea to the Class C felony of stealing, and a pre-sentence investigation was ordered. Winfree was charged last February with taking Missouri Lottery tickets from Bing’s Convenience Store in Altamont.
Jason L. Ward entered a guilty plea to three charges, one count of possession of a controlled substance with intent to deliver, Class C felony; one count of possession of drug paraphernalia with intent to use, Class A misdemeanor; and one count of possession of a controlled substance, Class A misdemeanor. The pre-sentence investigation was waived. Ward was sentenced to five years in the Department of Corrections on the felony charge and was ordered to participate in a long-term substance abuse program, per section 217.362 RSMo. On the two misdemeanor charges, the defendant was sentenced to 120 days in jail on each count, to be served concurrently, with credit for time served.
Franklin A. Holcomb admitted probation violations, and probation was revoked. The defendant was ordered to serve the previously imposed sentence of five years in the Department of Corrections on each of two counts (Counts 1 & 3) of burglary 2nd degree, Class C felonies, sentences to be served consecutively. On two separate counts (Counts 5 & 7) of burglary 2nd degree, Class C felonies, Holcomb was ordered to serve the previously imposed sentence of five years on each count, sentences to be served concurrently. The sentence for the first two counts (1 & 3) will run concurrently with the sentence for the second two counts (5 & 7).
In State vs. Timothy Claus, probation was revoked, and the defendant was ordered to serve the previously imposed sentence of six years on each of two felony counts, possession of a controlled substance and attempt to manufacture a controlled substance. The sentences will be served concurrently
Probation was revoked for Robert Wilson, charged with burglary 2nd degree, Class C felony. He was ordered to serve the previously imposed sentence of seven years in the Department of Corrections, in a regimented discipline program under Section 217.378 RSMo.
State vs. Scott Virtue was continued to Feb. 5 for trial setting. Sentencing for Michael Howard was set for March 12, 2004, by Judge Warren McElwain. Virtue, Howard, and Phillip Galloway allegedly manufactured methamphetamine in a rural Daviess County farmhouse, and attempted to back over an officer during a raid Aug. 26. Galloway has received a 10-year prison sentence.
Two cases were heard Jan. 13 by Judge Barbara Lame as follows:
In State of Missouri vs. Donald Clark, charged with one count of DWI, Class D felony, the defendant was sentenced to four years in the Department of Corrections as a prior offender. On a second count of driving while revoked, Class A misdemeanor, Clark entered a guilty plea and was sentenced to 30 days in jail, to run concurrently with the first sentence.
Mira Huffman had previously plead guilty to the Class C felony of possession of a controlled substance. She was sentenced to seven years in the Department of Corrections, execution of sentence suspended, and received five years probation. On a misdemeanor count of displaying the vehicle plates of another person, she was fined $100.
A dissolution of marriage was granted to Terrence Jason Hoover from Rebecca Lynn Hoover on Jan. 13 by Judge Daren Adkins.
Civil cases filed: Billy McLey vs. James Sensibaugh, petition for damages; St. Luke’s Hospital vs. John Sweany, petition on account for goods and services rendered; Ford Motor Credit vs. Phillip Gregory and Kathy Baldwin, petition for replevin; Joe L.
