A Chillicothe man was arrested March 16 after being pursued by both the Gallatin Police Department and the Daviess County Sheriff’s Office. Deputy Robert Mazur arrested Joshua Brown, 22, around 5 p.m. The deputy had attempted a traffic stop at 332nd and Highway 190, Lock Springs, after the Gallatin Police Department had terminated pursuit of the same vehicle about 15 minutes prior.

The yellow Mercury driven by Brown failed to yield and continued west on 332nd to the intersection of Highway 190 and 332nd Street, failing to stop for a stop sign. Brown then traveled north on Highway 190 at speeds up to 100 mph. The vehicle finally yielded at 190 Highway, north of Reel Avenue. Brown indicated to the deputy that he fled because he had warrants. A MULES check revealed convictions for driving while suspended in Chillicothe and Excelsior Springs.

The chase had started in Gallatin at 4:48 p.m., when an officer attempted a traffic stop on a suspected stolen vehicle. Brown fled in the vehicle which initiated a short pursuit south through Gallatin with speeds in excess of 60 mph. When city officers were notified that the vehicle was not stolen, the pursuit was canceled at 4:56 p.m. in the interests of public safety.

Brown then drove east on Highway M, and was later found near Lock Springs where the second pursuit by Deputy Mazur occurred.

Brown has been charged with resisting arrest for a felony, class D felony, driving while revoked, class A misdemeanor, failure to yield to emergency vehicle, class A misdemeanor, and exceeding speed limit by 20 mph or more, class B misdemeanor. He is being held on $15,000 bond.

Municipal charges of failure to stop at stop sign, failure to yield to emergency vehicle, resisting arrest, and careless driving have also been filed.

Richie King, 38, Hamilton, was charged March 17 with two counts of tampering with judicial proceedings/judicial officer, class C felonies. King made threats against the circuit judge and the juvenile officer on the third floor of the Daviess County courthouse. He is being held on $35,000 bond.

John Rhoads, 33, Hamilton, was arrested March 17 for misdemeanor no valid license and resisting arrest. Bond was set at $1,000.

Kurt Davis, 27, Gallatin, was charged March 16 with failure to appear on a misdemeanor traffic offense on a Gentry County warrant. He posted $50 bond.

Brett Olsen, 22, Cowgill, was charged March 22 with probation violations on original charges of driving while revoked, possession of marijuana and paraphernalia. Bond was denied.

County Commission

James Lewis, bridge supervisor, reported that they continue to haul rip rap to problem sites but are having difficulties with the condition of the roads. David Allen also met with the commission and Mr. Lewis regarding testing the quality of the rock to be delivered this season.

Bills were audited and paid.

Reta Rains, collector, submitted her annual settlement to the commission.

Danny Heldenbrand moved that repairs needed to the sewer line, discovered while making boiler repairs in the furnace room, were an emergency situation and made without delay of bid requests. David Cox seconded. Cox – yes; Heldenbrand – yes; Critten – yes. Motion carried.

Lance Rains, GHRPC, met with the commission regarding the Community Development Block Grant fund for Public Water Supply District #4. After discussion, Danny Heldenbrand moved to review the environmental assessment and add an addendum for a connection and plan expansion for PWSD #2. David Cox seconded. Cox – abstained; Heldenbrand – yes; Critten – yes.

Cheryl Alexander, health department, met with the commission reporting difficulties in obtaining affordable health insurance and other issues.

The commission inspected the wiring improvements at the building at 609 S. Main, contacting Penner Electric for changes.

Zac Johnson, Gallatin City Administrator, met with the commission regarding common issues.

Harold Allison, DeKalb County Commission candidate, met with the commission discussing duties of the office.

These are the approved minutes of March 15, 2010. All commissioners were present.

County Clerk

March 31 is the last day that absentee ballots may be mailed for the April 6 election.

Circuit Court

In Metlife Home Loans vs. Matthew Allen etal, a judgment against the defendants was entered.

In Tifny Otto next friend vs. Marquis Wheeler, a minor settlement was approved.

A dissolution of marriage was granted to Charles A. Curtis from Christina A. Curtis on March 17.

Civil cases – The State of Missouri has filed certificates of lien, Department of Revenue, taxes, against the following: Justin L. Jorgensen and Kari A. Curdy; Cynthia J. Kennedy; Timothy and Nanette Burge; Danny J. Gingerich.

Associate Division

George D. Rainey, Newtown, was charged March 16 with no valid license, third and subsequent offense, class D felony, speeding, class C misdemeanor, and failure to register vehicle, class B misdemeanor.

Telesfor H. Zamora, Loveland, Colo., was charged March 17 with felony non-support.

Ernest D. Childs, Polo, was charged March 22 with six misdemeanor counts of non-support.

Traffic Fines

The following are traffic cases which were heard in the Circuit Court of Daviess County involving a plea of guilty without contest and payment by mail of the standard fine plus court costs. The total fines assessed for defendants who reside outside of Missouri was $1,298.50 for 23 cases. The total fines assessed for defendants who reside in Missouri was $815.00 for 11 cases. Court costs collected for the State of Missouri amount to $58.50 for moving traffic violations. Missouri defendants, offenses and fines are listed below:

Civil Court

Property Damage: North Country Ford vs. Kenneth Standring was dismissed by the parties.

Breach of contract: A consent judgment was entered for Capital One Bank and against Jessica D. Griffin. Arrow Financial Services vs. Kevin S. Turovich was dismissed by the court without prejudice.

Suit on account: Default judgments were entered for Midwestern Health and against Joseph Davis; for Midland Funding LLC and against Kathryn Campbell.

Replevin: In Wachovia Dealer Services Inc. vs. Daniel Gingerich, a change of venue to Grundy County was granted.
